11/02/1955 119 REGULAR MONTHLY MEETING BOARD OF HEALTH HELD IN OFFICE OF BOARD NOVEMBER 2, 1955 ~ .. Present; Mr. Ralph T. Horton, Chairman; Mr. Dan D. Cameron, Mayor, Dr. J. C. Wessell, Dr. James H. Smith, Dr. J. C. Knox and Mr. H. M. Roland. On motion by Dr. Knox, seconded by Mr. Roland, the reading of the minutes was dispensed with. Under old business, the adoption of a County Ordinance for the proper disposal of garbage, trash and other refuse was taken up. After a lengthy discussion, the following Ordinance was adopted to go into effect six months from date of adoption. The motion was made by Dr. Knox, seconded by Dr. Wessell and carried. CONSOLIDATED BOARD OF HEALTH New Hanov.er County and City of Wilmington, N. C. REGULATIONS GOVERNING THE STORAGE, COLLECTION, TRANSPORTING, AND DISPOSAL OF GARBAGE AND REFUSE IN NEW HANOVER COUNTY BE IT ORDAINED BY THE CONSULIDATED BOARD OF HEALTH: , That the following regulations for the protection of the public health are hereby adopted and shall govern the storage, collection, transporting and disposal of garbage and refuse throughout New Hanover County, except that these regulations shall not apply to the territory within any incorporated municipality which operates its own garbage and refuse coll,ection and disposal system. Section 1. Definitions , The following definitions shall apply in the interpretation and enforce- ment of these regulations: a. The tenn person shall mean and include any individual, finn, corporation, association, partnership, business, or industrial establishment. b. The tenn health officer shall mean and include the New ~nover County Health Officer or his authorized agent. c. The term Garba,ge shall mean and include all putrescible wastes, including vegetable and animal offal and carcasses of dead animals, but excluding sewage and human body wastes, and recognizable industrial by-products; and shall mean and include all such substances from all public and private establishments, and from all residences. d. The term refuse shall mean and include all non-putrescible wastes. Section 2. Accumulation and Stora,ge of Garba,ge and Refuse ... . a. No owner, occupant, tenant, or lessee of any public or private premises shall permit to accumulate upon his premises any garbage or refuse. except in covered containers of a type approved by the Health Officer as being adequate sanitary con- tainers. Every such container shall be constructed of metal in such manner as to be strong, not easily corrodible, and rodent-proof; and shall have a capacity or not more than 30 gallons; and shall have fly-tight covers, which shall be kept in place at all times except when garbage or refuse is being deposited in or removed from such con- tainer. Section 3. Collection of Garba,ge and Refuse: Permits a. No person shall collect, transport, or dispose of garbage or refuse 180 without a written permit from the Health Officer; Provided, that this sub-section shall not apply to any person disposing of garbage and refuse f rom his own residence. b. The Health Officer shall issue such permit only when upon inspection he finds that the facilities, equipment, and~proposed operating methods of the applicant are in compliance with the requirements of these regulations. ~ -ot c. The Health Officer is authorized and directed to refuse any. application for a pennit to collect, transport, or dispose of garbage or refuse whenever he finds upon inspection of the facilities, equipment, and proposed operating methods are not in compliance with the requirements of these regulations. d. No person shall collect, transport, or dispose of garbage or refuse except in a manner approved by the Health Officer as being safe ahd sanitary. Every t ruck or other vehicle used for collecting and transporting garbage shall be covered with canvas or other material approved by the Health Officer. e. All appeals from the decision of the Health Officer shall be made in writing to the Consolidated Board of Health. Section 4. Disposal of Garba,ge and Refuse No person shall dispose of garbage and refuse except by one of the following methods; Provided, that this section shall not be construed to prevent any person from properly disposing of garbage or refuse from his own residence by burning or burying it in a ~e and sanitary manner. ~ a. By burning garbage or refuse in an incinerator of a type approved by the Health Officer as safe and sanitary; or - b. By burying garbage or refuse in sanitary landfills which shall comply wit~ the following requirements: (1) Every cell or trench shall be surrounded by a dirt fire- break extending at least two feet in every direction from such cell or trench. (2) All garbage or refuse deposited in such cell or trench shall be compacted and covered with dirt by the end of each day; and when the final deposit has been made in any cell cbr trench, the garbage or refuse therein shall be compacted and covered with at least two feet of dirt. (J) Every sanitary land fill shall be located at such distance from any public or private water supply that it will not endanger any such water supply. Section 5. Violations If any person shall violate the rules and regulations made by the county board of health he shall be guilty of a misdemeanor, and fined not exceeding fifty dollars or imprisoned not exceeding thirty days, as provided D~ Section 20 of Chapter 130 of the General Statutes of North Carolina. ..,. J Page No.3 - 181 Section 6. Partial Invalidity . If any sentance, caluse, paragraph, sub-section, or section of these regulations shall be judged invalid and of no effect, such decision shall not affect the remaining portions of these regulations. - Section 7. Effective Date These regulations .shall be effective on and after the 1st day of May , 19,22..... The Health Officer, Mr. Lassiter and Mr. Edwards were appointed a committee to work out with the interested parties a method for the satisfactory carrying out of the provision of the above Ordinance. The Health Officer gave a report on the progress of the Polio immunization program. Attendance at the clinics to this date has not been good. The Health Officer and Mr. Lassiter reported on the progress to date of the mosquito program which was to terminate for this calendar year about November 5, 1955. The program was much more intensive than in other years during the months of September and October. Approximately 4000 gallons of oil and approximately 1000 gallons of DDT Concentrate were used. Plans for the utilization of Mr. Geo. A. Shepard as a full-time man during the winter months was discussed, but inasmuch as the plans are incomplete at this time a report will be made later on this phase of the work. ~ \0...., Dr. Wessell suggested to the Health Officer that he consider the practicability of using the patch test in the tuberculosis program in children between the ages of one and twelve. Mr. Horton, Chairman of the Board of Health, reported to the Board on the deal with regard to the rental of the Buffalo Turbine and submitted a detailed report covering this operation; a cop,r of wh~ch report is included and made a part of these minutes. The Health Officer was instructed by the Board, on motion by Dr. Wessell, seconded by Mr. Roilansi, to continue the payment of $10.00 monthly to Miss Viola Bolyn, Secretary of the Board of Health, from the funds budgeted for the Insect and Rodent Control program, to compensate her for the work above and beyond her normal duties as Secretar,y in the keeping of the records, separate bank account,and the purchasing and dispensing of funds necessitated by this program.
