Knox, Dr. JailleS H. Smith and Dr. J. C. Wessell, Member ~neritus. The meeting v".s called to order by Chairman Holton. On motion by Hayor Capps, seconded by Dr. Knox, the minutes of the last meeting Here approved Hithout rE'-ading; copies having be'm sent to the Board members. Carried. Chairman Holton called to the Board's attention that four members of the Board haa authorized the H"o.lth Director to employ an attorney; that really this authority ,;as given at the Board of H(~lth meeting on August 0, 195t,. After a lengthy discussion of the legal matters that might pertain co the Board of Health; both Hayor Capps and Chaimmn Holton stated that the services of the City and County Attorneys ~lOuld be available to the health department. Hr. C, rter, attorney employed by the Health Director, stated that he had no contract with the H'Blth Director and tr~t no bill for his services would be submitted. Mayor Capps stated that he 'lOuld l~e to mke a motion that Hr. H. HcC. BiadIe be appointed plumbinG inspector; that he had made a Good plwnbing inspector, ar-cordinc to a letter of recOEill~ndation from the Health Director to Hr. Biddle Nhen he resigned as plumbinc inspector on AUGust 31, 1952; and he so moved timt hr. Biddle be retained. Notion was seconded by Dr. Kno;, and unani- mously carried. .. . On request of Chairman Holton, Hr. Lassiter, Sanitary Engineer, prescnted to me i30an' :;." inventory of the equipment on hand OMled by the Insect & Rodent Control. He sto.ted that about the only way to get parts for thie: equipment is to purchase other surplus equipment. He also advised that inforrr~tion from llale:i;;h is that 'Ie might not be able to purChase any more surplus property. No action pn the disposition of this equipement M1S taken; continued until the next m"eting of the Board ,-men the Health Director Hill be present. Hr. lassiter pl"esented the matter of requiring separate eroa~e traps for septic tanks to the Board. iIe stilted that recently the FHA has increased the size of the tank for a three (3) bed-room house. We have been using 500 ::al10n tanks, the FHA 600 and they liave increaoed to 900 gallon tanks. 11r. Chairman Holton informed the Board that tlwre existed some conflict betvleen the Health uirector, the Board of Count' CO;;Jilissioners and the City CounciJrnen; some misunderstandin[; betwcen all three groups. The big problem is that the Board of County Cormnissioners has been trying to get certain jnforrntion so as to prepare their part of the appropriation for the fiscal year 1959-1960, and the Health Director has repeatedly failed to meet \'lith them. A co,rulittce .,JaS appointed, composed of Dr. Wessell. Dr. Knox and Dr. Hare, to discuCls the responsibilities of the H"alth Dir"ctor "ith Dr. Davis. A motion ,~s made by Dr. Knox that New Hanover County cannot operate ,lith a part time H"alth Director, and asking that the Board go on record as disapproving his service as Health Director for Brunswick COUllty; notify BrunsVlick County Board of Health that after " ...'-' September 1, 1959, the Health Director will no longer be permitted to serve as Health Director of Brunswick County ami that his salaro' be set at ~ll,520.00. Motion ,as seconded by Dr. Smith and carried. ~ A motion was made by Dr. Smith that we respectfully request the board of County Commissioners to rescind their motion appointing Dr. Davis as county physician; that his functions are preventive medicine and not curative. }lotion seconded by Dr. KnoL anQ car,ied. ......... l'he Secl'etary Has instructed to '!rite the Board of County Commissioners that the Board of HeCtlth has ruled that Dr. Davis' services "lOuld not be available after September 1, 1959 to Brunswick County. This action is necessary due to the fact that his entire time should be devoted to public health work in New Hanover County. The City and County Attorneys were a<3ked to secure a ruling of the Attorney Generalis office as to the riGnt of the County Corrmlissioners to appoint the Healt;h Director to act as courlty physician in addition to his duties as Health Director. The Secretary was instructed to ''il'ite a letter to the Board of County Com- missioners explaining the apparent discrepancies in budgeted items.
