05/06/1970 5At: uJ513 MINUTES OF BOARD OF HEALTH MEErING - May 6, 1970 Present: Mr. J. Van B. Metts, Jr., Chairman, Dr. James Smith, Dr, Heyward Bellamy, Mayor L. M. Cromartie ~ - Since the number of people present for the Board Meeting was so large, we moved to the County Commissioners Building. Norman Rochelle - Trash: Mr. Norman Rochelle appeared before the Board re trash that had been dumped on his land. The people who dumped it1here had burned it in an effort to destroy names, etc, Mr. Rochelle said that he dug into the pile and found unburned letters, etc. with the same family name on all of them. He had a deputy from the Sheriff's Department and a Sanitarian from the Health Department to go out and see the evidence. The Sanitarian made pictures of it. He also went to see the people and they admitted they did it. Mr. Rochelle took out warrants for them for littering and trespassing, He was told by the Health Department officials that he was the proper one to take the legal action and that the Department would back him in any way we could. He also asked that the Department take out a warrant for the people and stated that he had been told that we would prosecute him if1he trash was not cleaned up because it was his land. The case will come up in court on May 12, 1970 and Mr. Rochelle was assured that we would cooperate with him. Adoption of 1968 Plumbin~ Code: Representatives of HUD from Atlanta, Georgia were present for the meeting re adoption of the 1968 Plumbing Code. Every phase of compliance had been met for grants except the adoption of the 1968 plumbing code. Copies of a letter from Timothy Wood, Director of Planning for New Hanover County and Wilmington, were given to the Board asking that we adopt this code without any exceptions, as exceptions are not acceptable to federal authorities. Mayor Cromartie made the motion that we adopt this code along with the 1968 uniform residential build- ing code as applicable to the Health Department and to include one and two family -- dwellings. Dr. Smith seconded the motion. Motion carried. (Proper notices will be posted and published.) Minutes of the April 8 meeting were approved by motion of Mayor Cromartie, seconded by Dr. Smith. Delegation relative to building on Charter Drive and Hillsdale Avenue on Undersized Lot: A delegation, with Col. McClelland as their spokesman, appeared before the Board re a house being built by Henderson Real Estate on lot 96. A petition with twenty-four signatures had been submitted to Mr. Metts, Chairman of the Board of Health. These people said they were not allowed to build on just one of these 50 x 150 lots but were told by Health Department representatives that these lots were too small and that they would have to purchase two lots. Mr. Henderson had been allowed to build on only one of these lots by representing it as a hardship case. Andrew Ashe, one of the delegation stated that he would have bought this lot at a reasonable cost, but that Mr. Henderson asked $2500 for it. The petition was asking that build- ing be stopped. Dr. Knox had already notified Mr. Henderson to stop building until this was settled, but according to reports from the people who were present, he was still building on May 5, Mayor Cromartie made the motion that the builder be noti- fied in writing to cease all building until all requirements have been met. This was seconded by Dr. Bellamy. Motion carried. (Letter was written on 5-6-70 and delivered in person by Mr. Cranford) - --..... Percolation Test Budget: At the last Board of Health Meeting motion was made and passed that we hire a man and begin perc test in thirty days. It was brought to the attention of the Board that the Commissioners had not yet approved this budget, therefore no action could be taken. Dr. Smith made the motion that we ~ke an 514 l0514 official request to the Commissioners that this budget be approved. Mayor Cromartie seconded the motion. Motion carried. Mr. Rochelle:, who was still present, asked the Board to allow him to build on a lot in Dixon Acres that he was being held up on because of improper drainage. ... He claimed that a permit had been issued to another builder in the same area 1 after he was turned down. The Board referred this back to Mr. Cranford and Dr. ~ Knox since this was an administrative matter. Due to the hour, the Board recessed until 7:30 A. M. tomorrow - May 7, 1970 CONTINUED MEETING OF THE BOARD OF HEALTH - May 7, 1970 - 7:30 A. M. Present: Mr. J. Van B. Metts, Chairman, Mayor L. M. Cromartie, Dr. James Smith, Dr. Frank Reynolds Letter from Planning Department re Large Sub Divisions: The letter from the Planning Department states that the Commission is concerned over the pollution of ground in New Hanover County and suggests that package treatment plants be used whenever possible. One subdivision was cited by them just off U. S. 421 south of Myrtle Grove Junction which will contain 354 homes. Dr. Knox informed the Board that the soil in this particular sub-division is sandy and will take a septic tank and that there is some question as to whether the Air and Water Departments will approve this package teatment plant. Dr. Knox also reviewed the septic tank problems in the county and the lack of control on sub divisions. Mr. Metts stated that the county has a sub-division ordinance and asked that Dr. Knox get a copy of this from Mr. Bowden, County Administrator. Mr. Metts also suggested that our people plan more closely with the Wilmington-New Hanover Planning Commission. By common consent the Board referred this matter back to Dr. Knox and Mr. Cranford and suggested that a letter be written to Mr. Tinga of the Planning Commission stating that the Board has asked Dr. Knox and his staff to get together with members of the Planning Commission to handle this matter. , , ~ Wording in County Mobile Home Ordinance: Dr. Knox called to the attention of the Board that in the new county mobile home ordinance the definition of enforce- ment officer reads, the Building Inspector or his representative and the Dir- ector of Environmental Health. Dr. Knox feels this should be the Director of Health, striking out the word Environmental. Mr. Metts suggested that Dr. Knox get Mr. Fox to draw up an amendment to the ordinance to be approved by the County Commissioners. This was made a motion by Mayor Cromartie, seconded by Dr. Smith. Motion carried. Laboratory: Word has been received from the State Board of Health that it is possible to certify Health Department Laboratories for Medicare and Medicaid if the laboratories meet the conditions of participation. Dr. Smith made the motion that we proceed with getting our Laboratory certified. Dr. Reynolds ssonded the motion. Motion carried. Budget: Copies of the Tentative Budget for 1970-71 had been mailed to all members of the Board for study. Mayor Cromartie made the motion that the Board accept the Tentative Budget as presented. Dr. Smith seconded the motion. Motion carried. ~ ~ ~ rfmS'5 ".4 Reorganization of Board of Health: Letters had been mailed to all members of the Board of Health from J. Van B. Metts, Jr., Chairman of County Commissioners and Luther M. Cromartie, Mayor of the City of Wilmington, asking that the Board of Health disolve itself as a Board operating under the special act of the Legislature and reorganize as a Board under the General Statutes of North Carolina. Mr. Metts explained to members of the Board that this action was necessary for consolidation purposes. The Board could do this or it could be done by the Legis- lature. Some of the changes that this action would bring about were pointed out by Dr. Knox - the composition of the Board would be changed to include a pharmacist and an interested citizen - the books will be moved to the County Auditor's Office - appointments to the Board will be for four year terms - meetings are to be at least quarterly. Dr. Reynolds made the motion that the 'Board of Health disolve itself as of June 30, 1970, Dr. Smith seconded the motion, motion carried. There being no further business, the meeting was adjourned.
