07/11/1979 " 00770 MINUTES OF REGULAR MEETING OF BOARD OF HEALTH, July 11, 1979 Present: Dr. J. William Eakins, Chairman, Dr. Murray Seidel, Mr. R.K. Reeder, Mr. J.R. Reaves, Mr. Deother Melvin, Mrs. Roma Lee Hall, Dr. Larry Neal and County Attorney James Fox ,"".. ,.6 Absent: Mrs. Vivian Wright, Mr. R.E. Carter Minutes of the June meeting were approved as presented. Motion was made, seconded and carried that the Board go into Executive Session to discuss personnel matters. Executive Session: During the executive session, Mr. Reeder, Chairman of the Personnel Interview Committee for employing a Local Health Administrator gave the following report: Applications Received/Competitive Applicant Listing Six (6) Interviewed - Two (2) Additional Applications Received Eight (8) Interviewed - Three (3) Recommendations for Board of Health Approval to Hire Mr. James M. Brown Selection based on Following Criteria: ...~ Professional Qualifications Educational Background Transferee and Availability within State System Administrative Experience (Progressive and Aggressive) Community - Civic - Professional Association Involvement Personal References - Dr. Seidel made the motion that the New Hanover County Board of Health hire Mr. James Brown as Health Administrator after consultation with the Department of Human Resources and County Commissioners. Motion was seconded by Mrs. Hall. Motion carried. The Board agreed to leave negotiations for salary up to the Committee. Salary is subject to State and Local regulations. Motion was made, seconded and aarried that the Board return to regular session. After the regular session reconvened the above mentioned motion was read from minutes taken during executive session. Animal Control Ordinance: Suggestions were made that instead of Animal Control Department of New Hanover County - wording throughout the ordinance read Animal Control Division of New Hanover County Health Department. Dr. Neal made the motion that we adopt the Animal Control Ordinance which had been given to the Board Members at the June meeting with above correction, and that we ask the County Commissioners to rescind their present ordinance. Motion was seconded by Dr. Seidel. ce7Tl During the discussion following this Dr. Eakins asked that we give copies of the Ordinance to the County Commissioners and ask for their opinion and advise them that we will vote on this ordinance at the August meeting. Mr. Fox stated that he would like to confer with the Institute of Government to see if the Board of Health or the Commissioners should adopt the Ordinance. Motion was seconded and carried. - Symposium on On Site Residential Water Supply and Sewage Disposal Dr. Eakins gave a report on progress of the Symposium plans. Merit Raises _ the Health Department Employees will have to be treated the same as all other County Departments. 2. No reclassifications were approved, except those required by the State. 3. New Position for Sanitarian I was approved. Position for LPN not approved. 4. Auto Allowance, Telephone and Postage, Printing, Travel, Meetings and Schools, Supplies and Materials approved. Requested equ~pment approved. 5. Since the Backhoe was purchased in 1978-79 budget year no additional funds for this purchase were approved. 6. Quote from Mr. Eller's budget notes: "No funds were requested nor recommended to have a consulting firm study the Department for efficiency and personnel performance." 7. Before a study is made to reevaluate comparative salaries for similar positions of responsibility and workload is done, the Office of State Personnel should be consulted. 8. An additional $1,000 was added to the Animal Control Budget to give distemper shots to puppies being impounded. Composting Privy - Mr. Sampley: Mr. Ted Sampley appeared before the Board to ask that he be allowed to install a Composting Privy for his pottery shop near Carolina Beach. After discussion of this type of sewage disposal and agreement that it would be on an experimental level, Mr. Melvin made a motion that the Board of Health allow Mr. Sampley to construct the privy and that the Health Department monitor and report to the Board of Health in thirty days after installation to see if it complies with Health Department and State Regulations. This to be done providing a solution be found, within the law, to dispose of gray water. Dr. Seidel seconded the motion. Motion carried. -II --' Appeal on Well Location - Mr. Stovall A request for variance from the "Ordinance Governing the Construction of Wells and Private Water Supply Systems Within the County." The home is owned by C. Gordon Smith, M.D. on Beagle Trail. The Ordinance states that a well cannot be placed within 50 feet of Chemically Poisoned Soil. The well in question is only 43 feet from the chemically treated foundation of the house. A letter was given to members of the Board from Dr. Smith requesting a waiver be grant- ed and stating that in his opinion there is no danger from pollution since the well is 150 feet deep. Mr. Fox said that the Ordinance would have to be changed before a variance could be made since there was no provision in the Ordinance for variances. Mr. Reaves made a motion that the Well Ordinance be ammended and that Paragraph 9 read "These distances may be reasonably increased or decreased by the Board of Health when site conditions warrant." Motion was seconded and carried. Dr. Seidel made a motion that the variance be granted to Mr. Stoval for the above mentioned home and that the drillers log be prssented to substantiate safety.
