09/10/1980 00836 -- The New Hanover County Board of Health met on Wednesday, September 10, 1980 at the New Hanover County Health Department. - Members Present. Murray K. Sei de 1, M. Price, Recording Secretary Dr. Murray Seidel, Chairman, called the meeting to order at 8:07 A. M. and called for corrections to the August 6, 1980 minutes. Mrs. Hall moved the minutes be approved. Mr. Grathwo1 seconded the motion and it unanimously carri ed. Dr. Eakins presented a proposed Tattoo Ordinance for New Hanover County. After discussion and some minor changes, Dr. Eakins moved the proposed Tattoo Ordi- nance be adopted by the New Hanover County Board of Health. Mrs. Hall seconded the motion and it unanimously carried. A copy of the Ordinance is attached to these minutes. Dr. Seidel announced the appointment of Mr. Melvin, Mr. Brown and himself to serve on the Sickle Cell Committee and invited anyone else interested in serving to let it be known. He announced that on September l5, 1980 this committee would meet with George Cherry, State Consultant; Mary Susan Varner, Local Sickle Cell Representative; and Mr. Hawes, New Hanover County Schools, to make plans for Sickle Cell Screening in the New Hanover County Schools. After some discussion including renumbering the sections of the amendment, Dr. Eakins moved that the first five sections of the amendment to the New Hanover County Sewage Disposal Ordinance be adopted. Dr. Seidel seconded the motion and it unanimously carried. ~ - After much discussion Dr. Eakins moved that the Board of Health approve, in principle, section #6 of the proposed amendment to the New Hanover County Sewage Disposal Ordinance, with this section to be reviewed in six months or after the Commissioners have had time to review and establish IDiilintained drainage districts. Mrs. Hall seconded the motion and it carried with Mr. 0'Shie1ds voting "no". Mr. Brown presented the contract between the Board of Health and the Sheriff of New Hanover County to provide medical care for those detained in the County Jail. Mr. Melvin moved that the contract be approved. Mr. Grathwo1 seconded the motion and it unanimously carried. 00838 - ~ A letter received from Dr. Calvin MacKay, TB Chest Clinician, recommended we discontinue use of 70mm x-ray films as a screening or diagnostic tool effective October 1, 1980 due to' significantly more KV needed for 70mm films, inferior diagnostic quality, constant service problems and difficulty in obtaining parts and it is an outmoded screening method. Dr. Eakins moved that the Board of Health follow Dr. MacKay's suggestion with the Health Department discontinuing the use of 70mm films effective October 1, 1980. Mr. 0'Shie1ds seconded the motion and it unanimously carried. - Mr. Brown requested and recommended that the Board accept a rate adjustment from $8 to $11 per visit and $14 to $16 per visit for the male Health Aide and male R. N. respectively, beginning October 1, 1980. Dr. Eakins moved that these rates be adjusted as recommended for the male Health Aide and RN. Mr. Whaley seconded the motion and it unanimously carried. Mr. Brown informed the Board that Dr. Robert Weinstein, a local Psychiatrist, has indicated that patients with depression on Tricyclic anti-depressant drugs such as E1avi1 may be at risk when insecticides are present in the environment. Indicating that insecticides metabolize the drugs for up to two weeks, Dr. Weinstein was con- cerned with the effects of spraying compared to the effects of the insecticide on depressed patients and wanted the Board of Health to know of this concern. Dr. Eakins told the Board his investigation found no documented data to substantiate this claim. The Board took no action at this time. - . Mr. Brown advised the Board that our State Milk Sanitarian recommended the Board of Health adopt the latest Pastuerized Milk Ordinance (1978) since we are presently operatin9 under the old 1965 Pastuerized Milk Ordinance. The major revisions in- clude (1) antibiotic testing and (2) tamper prOof caps for containers. Mr. O'Shields moved that the 1978 Pastuerized Milk Ordinance be adopted by reference. Mr. Melvin seconded the motion and it unanimously carried. _.. Mr. Brown reported that Mr. Cooper, County Manager, has asked the Management Support Consultant for the State to come to New Hanover County to flow out our paper work, look at the paperwork process, and make recommendations. When this data is gathered and analyzed, it will be forwarded with our follow-up request for the Word Process- ing System. Mr. Brown reported that our proposed Health Education Risk Reduction Grant has received preliminary approval from the State and Federal Agencies. When final approval is received, the proposal will be forwarded to the Board of Health for its acceptance. There being no further business, Dr. Neal moved that the meeting be adjourned. Notice is hereby given that a copy of the said amendment to the ordinance "Regulations Governing Ground Absorption Sewage Disposal Systems of 3,000 Gallons or Less Designed Capacity" is posted on the door of the New Hanover County Court House and that copies are on file and available for inspection in the office of New Hanover County Health Department, 2029 South 17th Street, Wilmington, North Carolina. This ordinance will be enforced beginning November 15, 1980. ~o p.~1 .' , AMENDMENT TO NEW HANOVER COUNTY HEALTH DEPARTMENT'S RULES AND REGULATIONS GOVERNING GROUND ABSORPTION SEWAGE DISPOSAL SYSTEMS OF 3,000 GALLONS OR LESS DESIGN CAPACITY 1. (a) Any individual lot that requires on-site waste water disposal shall have a detailed soil evaluation and lot inspection by an agent of the New Hanover County Health Department's Environmental ~ 'Health Division before any improvements or modifications of the ::site are made, including drainage, ditching, fill, roads or changes to the topography, and before a septic tank permit is issued. Any tract of land proposed for subdivision pursuant to the New Hanover County Subdivision Ordinance shall receive a general evaluation, and inspection by an agent of the New Hanover County Health Department, Environmental Health Division, of the largest definable soil class or classes in the tract. The Health Depart- ments requirements, recommendations, and clarifications relative to water systems and waste water disposal in the proposed subdivision shall be sent to the Subdivision Review Committee, the Planning Depart- ment and the owner/developer. 2. (a) All lots using on-site ground absorption sewage disposal systems shall contain and include sufficient area to accommodate replacement nitrification fields as specified in the soil evaluation and lot or tract inspection. (b) Two compartment septic tanks, or septic tanks with an equivalent efficiency of a two compartment tank, shall be used with all soils. . ,. . 3. If the soil on a lot is classified Type IV and owner/developer cannot or will not modify it to a provisionally suitable class, the lot shall not have an on-site, ground absorption waste water disposal system. The lot may be developed USing alternative systems including community or county sewage disposal. 4. If soil improvements or modifications are made to soils that were originally classified provisionally suitable or unsuitable soil, including Type II, III and IV, prior to the soil evaluation and lot or tract inspection, the agent from the New Hanover County Health Department, Environmental Health Division, shall not be required to accept or approve a change in soil classification arising from the improvements or modifications when those improvements or modifications are not self-sustaining, and will, in the Health Director's opinion, require maintenance. 5. Any lot or tract of land requiring a soil evaluation or inspection shall have its boundaries clearly marked and shall be readily access- ible to the agent from the New Hanover County Health Department, Environmental Health Division. Section 1. Definitions For the purpose of this chapter, the following words and phrases when used herein shall be construed as follows: Tattoo. The word "tattoo" shall mean to mark or color the skin by pricking in coloring matter so as to form indelible marks or figures or by the production of scars. Tattoo Establishment. The words "tattoo establishment" shall mean any room or space where tattooing is practiced or where the business of tattooing is con- ducted or any part thereof. Tattoo Operator. The words "tattoo operator" shall mean any person who controls, operates, conducts or manages any tattoo establishment, whether actually perform- ing the work of tattooing or not. Tattoo Artist. The words "tattoo artist" shall mean any person who actually performs the work of tattooing. Section 2. Permits; application therefor; inspections. No person shall operate a tattoo establishment, or engage in the practice or business of tattooing as a tattoo operator or as a tattoo artist unless such person shall first secure a permit from the director of public health or his duly authorized assistant. Applications for any such permit shall be made in writing on a form perscribed by the director of public health, wherein the applicant shall agree to conform to all ordinances, rules and regulations govern- ing such places now in effect or as subsequently enacted, and to permit such examination and inspections as may be deemed necessary by the director of public health. Before such permit is granted, it shall be the duty of the health officer to cause an inspection to be made of the premises or tattoo establish- ment in which the business is to be conducted and to refuse said permit if the conidtion of the premises, its equipment, or the health of the applicant shall not conform to the requirements of this chapter, but if the same do conform to the requirements of this chapter, the director of public health shall issue the permit requested. It shall be the further duty of the health officer to cause inspections to be made from time to time of all tattoo establishments and the equipment thereof, and if said place of business is not maintained, conducted or operated in confi rmi ty wi th the requi rements of thi s chapter as now enacted or as subsequently amended, then the director of public health may suspend the permit of the operator or artist until said tattoo establishment and the operation there- of is made to conform to the requirements of this chapter. Section 3. Term of permits; renewal of permits. All permits issued pursuant to this chapter shall, unless sooner revoked as here- inafter set forth, expire on December thirty-one following their date of issue. Renewal of permits shall be made on or before January 1 following their date of issue and the requirements for the renewal thereof shall be the same as for new permits as set forth in this chapter. Section 4. Form and transfer of permits. All permits granted shall be issued in the name of the individual person applying therefor, shall give the location of the tattoo establishment where said applicant will operate and shall not be transferable. Section 5. Physical examination of and health requirements for tattoo artists. Each tattoo artist shall have an annual physical examination reported on a form to be prescribed by the department of public health, which physical examination shall include an X-ray of the chest and such other laboratory tests as may be deemed necessary by the depa rtment of pub 1 i c health. A report of sai d phys i ca 1 examination and laboratory tests shall be presented with the application for each permit for a tattoo establishment or for any renewal thereof. No persons shall engage in tattooing as a tattoo artist while in the communicable stage of any disease, including the common cold. Section 6. Records required to be kept. Proper records for each patron or customer shall be kept and maintained by the tattoo operator of each tattoo establishment, which record shall include the patron or customer's name, address, date, serial number if a service man, and signature of patron or customer. All records shall be available for inspection upon request of department of public health. Records to be kept for one year from date of tattooing. Section 7. Minors. No tattoo operator or tattoo artist shall tattoo any person who is under the age of eighteen unless such person shall present to the tattoo operator or artist notarized consent to such tattooing from a parent or guardian of such person. In this event, the notarized consent aforesaid shall be attached to and become a part of the records referred to in section 6. Section 8. Prohibited designs, words, etc. No tattoo operator or tatto artist shall tattoo on any person any religious design or any obscene word, phrase, or design. Section 9. Removal of tattoo. No tattoo operator or artist shall remove or attempt to remove any tattoo. Section 10. Penalties. Any person who shall conduct a tattoo establishment or engage in business as a tattoo operator or tattoo artist without first securing a permit therefor, or when such permit previously issued has been revoked or suspended, shall be guilty of a misdemeanor and subject to a fine of not more than $50 or imprisonment for not more than 30 days as provided by Section 203 of Chapter 130 of the General Statute of North Carolina. Each day's operation in violation of this ordinance shall constitute a separate offense. The director of public health shall revoke the permit of any person who shall be convicted on two separate occasions within a twenty-four months period of violating any of the provisions of this chapter. STANDARDS FOR THE OPERATION AND MAINTENANCE OF TATTOOING ESTABLISHMENTS. Section 11. Operating room; toilet, etc., facilities. Each tattooing establishment shall have an operating room, which operating room shall be separate and apart from a waiting room, or such other room or rooms as may be used. Patrons or customers shall be tattooed only in said operating room. Said operating room shall be equipped with hot and cold running water, together with such sinks and basins as may be necessary. Sufficient toilet, urinal and hand washing facilities shall be accessible to customers, operators and artists within the tattoo establishment or the building in which said tattoo establishment is located. Section 12. Personal cleanliness of tattoo artist; required equipment. There shall be available within said tattoo establishment adequate hot and cold running water, soap, approved germicidal solution, individual hand brushes and fingernail files for each tattoo artist. Each tattoo artist shall clean his fingernails with an individual file, wash his hands with soap and hot water using individual hand brush and thoroughly rinse his hands in a germicidal solution to be approved by the department of public health before working on each patron or customer. An individual paper towel or napkin shall be used for drying the tattoo artist's hands after rinsing. Each tattoo artist shall wear sterile rubber gloves and a clean gown or coat while actually engaged in tattooing. Section 13. Cabinets for storage of equipment. Adequate cabinets for the storage of instruments, dyes, carbon and stencils shall be provided for each operator and shall be maintained in a sanitary condition. Section 14. Floors; disposition of waste material. The floor of tattoo establishment shall be of impervious material and shall be at all times maintained in a clean condition. The tattoo establishment shall have proper facilities for the disposition of waste material. Section 15. Ventilation; walls and ceilings. Tattoo establishments must have adequate light and ventilation, and all walls and ceilings shall be painted a light color. Section 16. Instructions as to care of skin after tattooing. Printed or mimeographed instructions, approved by the director of public health, shall be given to each patron or customer on the care of the skin after tattooing as a precauti on to prevent i nfecti on after each tattooi ng. A copy of these i n- structions shall also be posted in a conspicuous place in the tattoo establishment, clearly visible to the person being tattooed. Section 17. Preparation of area to be tattooed. When it is necessary to shave the area to be tattooed a new blade for each patron shall be used when a safety razor is employed, and the permanent parts of sai d safety razor shall be treated as hereinafter set forth for the treatment of a straight razor If a straight razor is used, it shall be cleansed with soap and water, rinsed in clean water and then sterilized be- fore the razor is used again on another patron. After shaving the area to be tattooed, said area shall be cleaned with an approved germicidal solution in a sanitary manner before the design is placed on the skin. Section 18. Stencil for transferring design. The stencil for transferring the design to the skin shall be thoroughly cleaned and rinsed in an approved germicidal solution. Section 19. Removal of excess dye; bandages. The excess dye originally applied to the skin shall be removed with indivi- dual sterile gauze or sterile cotton only. The area tattooed shall then be allowed to dry and the entire area covered with a piece of sterile gauze only which may in turn be covered with a piece of tissue and fastened with adhesive. Section 20. Needles. A sterile set of needles must be used for each patron or customer. Needles used in tattooing shall be sterilized and if not immediately used, stored in sterile containers. The open end of the needle tube of the tattooing machine shall be cleaned and sterilized in a similar manner before each use. Section 21. Sterilizing device required and methods of sterilizing equipment. Each tattoo establishment shall be equipped with a sterilizing device to be approved by the director of public health. Sterilizing can be done by' 1. Autoc 1 a vi ng 2. Immersion in Formaldehyde 8% and alcohol 70% for 18 hours. 3. Immersion in 40% aqueous formalin for 12 hours. 4. Immersion in alkalinized glutaraldehyde (2% aq.) for 10 hours. 5. Ethylene oxide gas by manufacturers recommendations.
