05/06/1981 00868 The New Hanover County Board of Health met on Wednesday, May 6, 1981 at the New Hanover County Health Department. Members Present: J. William Eakins, M. D., Chairman Hobart Whaley, Vice Chairman Donald Blake Carl Durham Hal A. Franklin, II, M. D. William Grathwol Roma Lee Hall Larry Neal, D. D. S. Members Absent: Richard Reeder Others Present: James M. Brown, Secretary to the Board Fred Davenport, County Attorney Mabel B. Price, Recording Secretary Dr. Eakins, Chairman, called the meeting to order at 8:00 A. M. and called for corrections to the April 1,1981 minutes. Mr. Grathwol moved the minutes be approved. Mr. Whaley seconded the motion and it unanimously carried. The amendment to New Hanover County's Regulations Covering Ground Absorption Sewage Disposal Systems of 3,000 Gallons or Less, Section 5a concerning licens- ing Septic Tank Contractors and Pumpers was presented by Mr. Grathwol of the Committee to rewrite the septic tank ordinance. Mr. Grathwol reported the Committee had met twice with Septic Tank Contractors and Pumpers and had good input from this group regarding licensure, septic tank care, permits and other issues. Dr. Eakins moved that Section 5a be adopted in its entirety to be effective July 1, 1981. Mr. Grathwol seconded the motion and it carried unani- mously. This will be properly posted and published. A copy is attached as a part of these minutes. Additional definitions and details are needed to complete Section 5b of the Amendment which concerns reporting, permits, repairs and modification. Section 5b will be presented at a future Board Meeting. Ted Sampley appeared before the Board to report on and discuss unpermitted septage dumping in the County, most specifically off Carolina Beach Road. After much discussion the Committee presented the following statement regarding unpermitted dumping of septic tank waste for adoption by the Board: "The recent report regarding the dumping of septic tank wastes at a location other than the Loughlin Waste '1ater Treatment Plant was in- vestigated. Results of the investigation, to date, indicated that the unpermitted dumping does not appear to be an immediate threat to the public's health. Further investigation is in progress. This in no way implies that the Health Department approves such sites, nor does it alle- viate the Health Department's responsibility to assure that unapproved dumping sites are not used in the future. The informal manner of permit granting in the past, makes it difficult to oroceed with any formal prose- cution of the reported violation. 0086S All septic tank installers and oumoers are being notified by mail, of the policy, that all contents from septic tanks shall be disposed of only at approved locations. Future violations shall be deemed willful and subject to formal action as provided for by State and local regulations. Results of the completed investigation shall be made available to the Di stri ct Attorney for hi s further i nvesti gati on and recommendati ons." ~ - Dr. Eakins moved the above statement be adopted by the Board. Mrs. Hall seconded the motion and it carried unanimously. Mr. Blake told the Board that he had gone with Judge Burnett to look at some of the illegal dumps in New Hanover County and was amazed at what he saw. Mr. Blake indicated his and Judge Burnett's concern to help clean up the County and prevent this type of future environmental abuse in New Hanover County. Mr. Blake was also curious as to the Health Department's role in Solid Waste Disoosal and oroblems associated with it. Dr. Eakins suggested that the laws against this be enforced and that rewards be offered for those catching and helping to convict anyone for illegal dumping. Mr. Blake comment- ed that dumping must also be more accessible to discourage indiscriminate and illegal dumping. There being no further business, Mr. Grathwol moved the meeting be adjourned. Dr. Eakins seconded the motion and it unanimously carried and the meeting was adjourned at 9:15 A. SEfS'FA'~, OF l;ORTIl CAROLINA 'l1SiEu COUl;TY OF NEW HANOVER ( ) PUBLIC NOTICE The New Hanover County Board of Health Aerewith~rdains that Section 5 of the New Hanover County's Regulations Covering Ground Absorption Sew- age Uisposal Systems of 3000 Gallons or Less Designed Capacity 18 hereby amended in its entirety to read: 5-a Any individual, partnership or corporation constructing, installing, repairing, pumping or altering in any way a septic tank system or privy within New Hanover County must be licensed by the Board of Health of New Hanover County. Such license shall be issued by the Board of Health to the responsi- ble individual upon the successful completion of a written examina- tion; this examination shall be compiled by the Health Director as to indicate adequate knowledge of this ordinance and the North Caro- lina Ground Absorption Sewage Disposal System Act of 1973 and all sub- sequent amendments. Exception to this requirement of a written exam- ination shall be those responsible individuals applying for and re- ceiving licenses before July 15, 1981, or homeowners applying for a license to perform work on their own septic tank or privy system. Those individuals or homeow~rs applying for licenses before July 15, 1981, shall have 30 days after July 15, 1981, within which to receive said license for the purpose of this exception to requirement of a written examination. Such owners/occupiers shall be issued limited license, for their specific addresses. The issuance of a license in no way negates the issuance of permits and approvals as specified elsewhere in this ordinance. License shall be subject to revocation by the Health Director upon the licensee's willful violation of the rules, regulations of this ordi- nance or of the applicable North Carolina laws. Appeals of revocation can be made to the Board of Health. Relicensing shall only be done after the responsible individual passes a written examination. License fees shall be set by the Board of Health and payable on or by July 15 of each year, beginning July 15, 1981: Non-Payment of license fee by July 15 shall result in a suspended license. Any license not reissued by October 15 shall be considered to be permanently lapsed and will be reissued to the responsible individual only upon satisfac- tory completion of a written examination. .
