All members were present. AGENDA Secretary Adger moved that the agenda be approved as submitted, second by Member Washburn. Motion carried unanimously. MINUTES Chair Pollard moved that the minutes of the 10/27/2020, 11/2/2020, 11/3/2020, 11/12/2020, 11/13/2020, 11/16/2020, 11/20/2020, 11/25/2020, 12/7/2020, and 12/9/2020 Board meetings be approved as submitted, second by Secretary Adger. Motion carried unanimously. PUBLIC COMMENT Chair Pollard called upon the public in-person attendees for their comments or questions, limited to two minutes each. Seeing no public attendees and hearing no comments from the telephone attendees, Chair Pollard closed the Public Comment period. Draft Board Minutes – 01/12/2021 GENERAL DISCUSSION Chair Pollard called on the Board members for general discussion. Hearing none, he closed the General Discussion period. DIRECTOR’S REPORT a. Financial Update Chair Pollard called on Director Hunter-Havens for her report. She reviewed the Board of Elections Budget Report, noting that the department is over-budget on some line items due to the additional costs incurred in conducting a General Election during a pandemic, the unprecedented high turnout, and higher than average absentee-by-mail voting. Although 80.3 percent of the annual budget is expended through the first six months, a significant portion of the added expenses may be offset by additional CARES Act funds designated for election expenses, pending further guidance from the State Board of Elections (SBE). Director Hunter-Havens reported on bonus payments going out to the One Stop officials and Election Day precinct officials. These payments are coming from CARES funds totaling $46,800 specifically legislated for this purpose, Each Election Day official will receive $100 and each One Stop official will receive $19.56 for each day worked. Member Washburn asked there were any reported coronavirus cases among the approximately 468 election workers? Director Hunter-Havens reported there were none to her knowledge. b. List Maintenance Director Hunter-Havens reported that the New Hanover County Board of Elections conducted routine statutory list maintenance throughout the election period from September through December 2020:  Removed 5,461 voters from the registration rolls consistent with NC Gen. Stat. §163-82.14.  Processed 13,296 new registrations, 24,317 duplicate registrations, and 15,898 registration updates. In response to Board Member questions about the process for designating a voter as inactive, the Director explained that a voter who has not voted in or made contact in two General Election cycles (those elections occurring in even numbered years) receives a forwardable address confirmation mailing. If the voter does not respond within 30 days, the voter’s status is changed to Inactive. An Inactive voter is still registered and may vote upon verifying or updating their address. After two more General Election cycles without contact with the Board of Elections, the voter will be removed after a similar attempt to contact the voter. If a voter was removed solely due to list maintenance, the voter is permitted to vote a provisional ballot. Provided the only reason the voter is not actively registered is removal due to list maintenance, the provisional ballot will be counted and the provisional application will reinstate the voter’s registration. There were Draft Board Minutes – 01/12/2021 about 12 provisional ballots in the 2020 General Election that were approved for this reason. This process strictly follows the governing statute. This is the main reason why the Board encourages voters to check their registration in the lead-up to an election. NEW BUSINESS a. 2021 Board Meeting Schedule The Board looked at the proposed schedule for their 2021 meetings. The schedule calls for monthly meetings through June, then 2 meetings in July and August, a regular meeting and a special meeting, with special weekly absentee meetings for the municipal election beginning October 12. After discussion, Chair Pollard moved to cancel the July 13 meeting and conduct board regular business on July 27 when the new Board terms will begin, and cancel the August 10 meeting and conduct regular board business including appointment of Chief Judges and Judges for the new term on August 17, second by Member Miller. Motion carried unanimously. b. FY21/22 Budget Enhancement Requests Director Hunter-Havens reviewed three proposals for budget enhancements for fiscal year 2021-22:  Change Election Official Management Software from EasyVote to VoterHub Managing the pool of election officials to staff precincts and one-stop voting sites is critical to successful elections. The office is currently using a piece-meal system based on EasyVote for database management but requiring use of other platforms to fill in gaps, such as Google Forms, mass emailing, and Microsoft Access and Excel. VoterHub offers a more comprehensive, cloud-based software program that can be customized to department needs. EasyVote is costing about $7,000 annually, while VoterHub will cost $3,934 in the first year and $3,139 annually for upkeep. Anticipated outcomes include reduced regular and overtime hours, reduced hours required to train seasonal support staff, and reduced errors and problems generated by the software.  Add position: Deputy Director The department has critical staffing needs to ensure continuity of operations in the dynamic election environment coupled with the increasing complexity of elections administration. This requested position will provide essential operations back-up for the director; ensure continuity of operations and compliance with complex statutory and administrative guidelines; and add needed depth in the public-facing aspects of election implementation. The budget for the position is still in development and will be based on the Job Assessment Tool for pay and position classification. The position can be filled before the 2021 Municipal Election begins the next cycle of three elections within a 12- month period. Draft Board Minutes – 01/12/2021 Add position: Logistics Specialist The scope of responsibilities, complexity of tasks required to conduct an election successfully, and multifaceted demands of the election timeline have steadily increased over the recent election cycles. The result is demands on staff that regularly exceed what can be reasonably managed by the current number of staff positions. The workload requires increasing reliance on temporary workers to execute critical election tasks rather than serving in supporting roles. Managing the supply chain and logistics of staffing and equipping up to 43 precincts and multiple One Stop voting sites pushes staff beyond their assigned responsibilities, creates safety and continuity concerns, escalates burnout and turnover, and intensifies the challenges of an already complex elections environment. The budget for this position is still in development and will be based on the Job Assessment Tool for pay and position classification. The position ideally will be filled before the 2021 Municipal Election begins the next cycle of three elections within a 12- month period. The Board voiced their strong support for the proposed budget enhancements and agreed to send a letter to the appropriate county officials, signed by the Board Members, endorsing the proposals. Director Hunter-Havens noted that she is holding off on filling the currently-budgeted Database & Systems Specialist position until she receives feedback on the enhancements. The proposed budget will also reflect and anticipate the shifting preferences for voting method, from Election Day to One Stop and absentee-by- mail, and the conduct of the 2021 Municipal Election and the 2022 Primary. The Board will have the opportunity to review the proposed Elections budget at their next meeting. The Board discussed the impact of the proposed 2021-22 budget on their options for One Stop voting for the two upcoming elections. The balancing factors in opening One Stop locations are voter turnout, cost and adequate access to polling sites. Financial Update The attached table provides the Board with a budget update, including the following:  Salaries and Benefits expended through FY20-21 7th Period (January)  Operating Expenses expended through FY20-21 7th Period (January)  Grand Total expended through FY20-21 7th Period (January) I have requested a transfer of $113,110.03 additional funds into the Elections budget to pay all current outstanding invoices. Due to the increased costs associated with conducting an election during a pandemic, the Board of Elections has exhausted 100% of their operating expenses budget. The approved FY 20-21 budget did not include funds for conducting a large absentee- by-mail election and operating nine (9) One-Stop “Early Voting” Sites. Both of these developments were not anticipated when the FY21 budget was requested last year given past voter trends and previous elections administrative and statutory requirements. The existing overages in the Printing (-26,891.02), Postage ( -24,478.90), Rent (-2,375.00) and Supplies (-17,643.13) line items are the direct result of expenses associated with by mail and early voting and contributed to the depletion of our operating expenses budget. The CARES funds allocated to the Board of Elections have been used to pay election officials and temporary employees working in the office during the election. As a result of the pandemic, the State Board required all county boards of elections to add three new positions to each in-person voting site and expand our capacity for curbside voting. In addition, the expected increase in the volume of absentee-by-mail voting required the creation and operation of a large absentee-by-mail processing center staffed by 9 to 20 employees for a three-month period to process over 38,000 absentee by mail requests. On Tuesday, February 2, 2021, the State Board informed county boards of elections that additional HAVA funds have been designated for county boards under Session Law 2020-17 based on their Department of Commerce economic tier and number of registered voters to meet the unexpected needs related to the pandemic. The amount of allocated funding for New Hanover County is $222,510. The General Assembly stipulated that in reimbursement of these funds, counties must certify that HAVA funds will not be used to supplant county funds. Use of the funds must adhere to the categories and permissible purposes established by the U.S. Elections Assistance Commission and the federal standards set by the Congressional grant authorization. An allowable cost is one that is necessary and reasonable for the proper and efficient performance and administration of the activities funded under the grant. Examples of allowable costs in this context could include cleaning supplies and protective masks for staff and poll workers, resources to meet an unanticipated increased demand for mail ballots due to self- Item # 2 Item # 4 Draft isolation and quarantine in response to COVID-19, temporary staff to process the increased absentee ballot demand, and physical and cyber security improvements. Allowable costs would not include those that are currently paid with state or local election jurisdiction funds, such as the regularly anticipated demand for mail ballots or other regular election-related services. b. The General Assembly further stipulated that in reimbursement of these funds, counties must certify that HAVA funds will not be used to supplant county funds. Use of the funds must adhere to the categories and permissible purposes established by the U.S. Elections Assistance Commission and the federal standards set by the Congressional grant authorization. While we considered an application process to receive additional funds above $10,000 (not to exceed $250,000), we were concerned that this would not be a fair and equitable decision-making process and would limit a county’s ability to address its specific needs. Similar to the criteria used by the General Assembly to award CARES Act funds, we have calculated each county’s award based upon economic tiers defined by the North Carolina Department of Commerce and the number of registered voters. Through this formulary, we aim to give the decision making to you directly since you know your county’s needs best. The session law appropriating these funds requires the counties to seek reimbursement from the State Board for eligible expenses. The attached FAQ document explains the reimbursement process, which is the same as CARES Act reimbursement processes. As you determine the needs of your county, please be mindful that at present time no additional funds have been authorized by Congress or the General Assembly. This means it is important to prioritize and effectively address multiple needs. While many counties may consider voting equipment to be a top priority, the designation of elections as critical infrastructure means it is also our duty to place even greater emphasis on both physical and cyber security than ever before. Please review any assessments conducted by the Department of Homeland Security or the National Guard and consider applying HAVA funds to remedy identified issues or areas of concern. Ideally, counties have designated capital funds to purchase voting equipment since there has been no federal or state commitment of funds for this purpose since the initial statewide procurement in 2006. Bottomline – please spend your funds wisely as we are not guaranteed additional funds in the near future. Please carefully review the additional documents provided with this letter. Would it be permissible to purchase an “emergency kit” that contained generators, power boxes, cords, led lights and other items to keep polling locations operational during a federal election? They would become necessary in the event of a cyber-attack that damaged the power grid. Yes. 2. To make election security improvements it would be more beneficial and cost effective for some of our counties if they could purchase entirely new buildings. Could HAVA funding be used for this so long as the county matches or exceeds the federal funding? No. HAVA funds could be used to pay for elections-specific security components that would be part of the new building, such as a security camera system. 3. The county wants to move the Elections office. The place they have in mind will need extensive work to allow for all of the equipment with outside loading area to move machines, set up area for supplies and tailor for the needs of Election Administration. How much of the HAVA funds would be available to us to help improve this project. Would this even be a project we could count on? HAVA funds could not be used to install a loading dock or build a supply room. HAVA funds could be used to pay for elections-specific security components that would be part of the new location. This might include security systems for elections storage rooms where equipment is stored, and the electrical work necessary to install the system. 4. In the same area as establishing toll-free telephone hotlines could a chat bot be set up by the counites? This is when voters could just text their questions in and they would receive automated responses. This can be done it multiple languages and updated over time based on the questions the chat bot is receiving. Yes. 5. I believe this would fall under educating voters concerning voting procedures, voting rights, and voting technology but would purchasing social media ads be permissible so long as they contained educational material? In that same vein, would hosting virtual town halls and using the funding to purchase cameras and a platform be permissible? I think this was the case with CARES but I feel some who missed out may want to try doing this now. Yes. 6. Can funds be used to purchase “Stand alone” internet connectivity – cameras for live streaming of meetings, trainings, etc. Yes. 7. Is it permissible to install glass barriers, push button entry, more security cameras, etc. with HAVA funds? If the security items are installed in areas commonly used by other county agencies, only the cost of the work done in the elections area can be paid for with HAVA funds 8. Can this money go to recurring expenses such as security (that requires a monthly fee)? The answer depends on the expense. If, for example, the elections board installs security cameras in the elections area, and recurring fees are required to store and access the video feeds, then HAVA funds can be used. 9. Can HAVA funds be used for a curbside wireless bell notification systems – where the potential curbside voter can push a button or drive over a sensor, wirelessly alerting the poll workers of their presence? Yes. 10. Regarding a hotline – Can the funds be used to pay costs from our phone vendor to set up the hotline or a phone bank that is physically staffed? Yes. 11. Can HAVA funds be used to purchase a DS450? Yes. 12. Can HAVA funds be used to purchase a second (backup) ElectionWare system? Yes. 13. Can HAVA funds be used to purchase dollies for Balotar printers? Yes. 14. Can HAVA funds be used to purchase MiFi jetpacks? Yes. 15. With this approval the county plans to move forward with construction on the new Government Center beginning mid-March. When preliminary plans for the building were produced, we began communicating with Facilities Management and the County Managers office regarding our security, storage, and functional workspace needs as a department. As a result of this communication it was determined early-on that the new building was likely not the best space for the Board of Elections office. Working closely with Sara Warmuth, Chief Facilities Officer, and Sheryl Kelly, Assistant County Manager, it was determined that the Executive Development Center (EDC) at the Northeast Regional Library, including the office space and three conference/meeting rooms, was the only space that met our ongoing needs, and allowed for some expansion during our busier seasons. While not a part of the EDC specifically, we will share the use of the David E. Paynter Room with the New Hanover County Libraries for functions that require use of the space, such as candidate filing, One-Stop voting, Election Day voting, and recounts. Additional use of the space outside of those planned times will require use of the Library’s reservation system. Discussions are on-going, but at this time the anticipated relocation would occur in early May. We will continue to use the workroom, storage cage, and Suite 34 at the current Government Center to store and prepare bulk supplies, store and test voting equipment, and prepare laptops for use during the election. These spaces will continue to be utilized for these processes until the county has established a new functional storage space, which should be completed during the summer of 2022. A secure cage should be installed along the back of the room, approximately 27’ wide and 10’ deep. This will be used to store confidential election documentation such as returned ballots, SOSA Applications, OVRD Applications, and absentee by mail ballots. The front portion of the room will be used for the storage of precinct/site supplies, precinct/site suitcases and for the packing and staging of these supplies as we approach an election. There should be at least one work station in this space for those temporary staff members that we bring on to assist us with the packing of these supplies. o On Election Day a Call Center will need to be run out of the Azalea Room. The shelving that is in this space year-round is on casters and the evening before the Election, this shelving will need to be rolled out into the hallway and stored against the wall. At least five (5) tables with laptops and phones will need to be set up as a way to support Chief Judges and other Election Officials on Election Day. This can be scaled down slightly in the evening as Chief Judges return with their materials so that there is some additional space for returned suitcases.  Oleander Room o The Oleander Room will serve, year round, as a secure storage and work space. Given the recent popularity of Absentee by-Mail voting, a trend that is expected to continue though future elections, it has become more important that we ensure that there is a designated work space to expand out and run an Absentee Ballot Processing and Call Center. As we approach each election a member of our staff, and the seasonal temporary staff tasked with assisting with the Absentee by-mail process will move in to the Oleander room where work stations, flat work surfaces for ballot packing, storage shelves and a secure storage cage will be contained. This secure storage cage will be approximately 15X15 and will used to securely store returned, and processed absentee by-mail ballots before and after they have been reviewed by the Board of Elections at an absentee Board Meeting. When not being used as a processing center, this will be only open workspace we will have to conduct other year-round business such as smaller scale training for Election Officials and supply development and organization.  Long Leaf Room o The Long Leaf Room will serve as our board meeting space, the home of our DS850 and as hoteling space for our temporary staff. This room will also periodically be used for small-scale trainings outside of, but in preparation for, upcoming Elections. o On Election Night this space would be used to store returned suitcases and supplies. Check in of supplies can be performed at the front counter and supplies walked back by other members of our team.  Paynter Room o The Paynter Room will be a critical area for elections moving forward. This space serves as a One-Stop Early Voting Site for each election, and will continue to serve as the H02 Polling Place for future elections. This site would also be used for candidate filing, and short-term organization post-election. Should the space be needed for events such as recounts, second primaries or other events that we cannot plan for on a regular basis we would need access to this space as well. We will be working with the New Hanover County Library reservation system for events outside of those noted here.
