BRIEF SUMMARY:
New Hanover County requires a county issued franchise to collect solid waste. Pursuant to County Ordinance 44.55,
the applicant has provided information about his business organization, equipment, personnel and fiscal responsibility.
The Environmental Management Director has no objections to the franchise request. The franchise period would run
for seven years.
Staff has reviewed only for compliance with the County Code. Prospective customers of any hauler must make their
own determination as to suitability of provider and services.
The first reading was unanimously approved on January 10, 2022.

Authorize franchise award. Upon award, the company will provide Certificates of Insurance, agree to not bring outside

STATE OF NORTH CAROLINA AWARD OF FRANCHISE AGREEMENT
FOR
COUNTY OF NEW HANOVER SOLID WASTE SERVICES
THIS FRANCHISE AGREEMENT made and entered into this the day of
20 , by and between NEW HANOVER COUNTY, North Carolina, a political
subdivision of the State of North Carolina, hereinafter called "County" and AVIAN CARTING,
LLC, a North Carolina limited liability corporation, with its principal mailing address is 3513
Bailiwyck Way, Wilmington, NC, 28409, hereinafter called "Operator."
WITNESSETH
WHEREAS, the County has, through the power granted to it under G.S. 153A-136,
adopted an ordinance regulating the collection and disposal of solid wastes and requiring that
all waste haulers have a license and a franchise in order to operate in the County, in order to
provide the residents and commercial customer of the County with reliable, environmentally
sound waste disposal now and in the future; and
WHEREAS, Operator has contracted with commercial and/or residential customers
located in New Hanover County in order to provide solid waste collection and disposal; and
NOW THEREFORE, in consideration of the mutual benefits inuring to the parties
hereto and based upon the mutual covenants contained herein and the considerations stated
herein, the parties do hereby covenant and agree, and County hereby conveys a non-
exclusive franchise to Operator, to collect and dispose of solid wastes to commercial and/or
residential customers in the County. The parties therefore agree to the following terms and
conditions:
1. Terms of Agreement. The initial term of this Franchise Agreement shall be seven
(7) years from the date of signing. The Franchise may automatically renew and
extend for a subsequent seven (7) year term, contingent upon County
Commissioners approval pursuant to G.S. 153A-46.
2. Scope of Services. For the term of this Franchise Agreement, Operator agrees to
provide commercial and/or residential customers with solid waste collection and
transportation to County -approved disposal sites.
3. Disposal at County -Approved Facilities. Operator agrees to dispose of all waste
collected in the County, as part of this franchise agreement, at County -approved
facilities consistent with State law. With regard to County -approved facilities, said
approval must be obtained by Operator prior to the disposal at said facilities, and
said approval shall be granted or denied entirely at the discretion of the County.
The County also has the authority to designate which facilities shall be used.
4. Administration/Billing. All billing of customers shall remain the responsibility of the
franchisee.
5. Franchise. It is understood and agreed that all of the terms and conditions of New
Hanover County Code Chapter 44, entitled "Solid Waste," pertaining to a franchise

for solid waste collections are incorporated herein by reference and made a part
hereof as if fully set forth, including but not limited to insurance requirements.
6. Personnel and Equipment. Operator shall equip and maintain all vehicles with staff
and equipment to comply with any applicable regulations and laws.
7. Independent Contractor. It is mutually understood and agreed that Operator is an
independent contractor and not an agent of the county, and as such, Operator, its
agents and employees shall not be entitled to any County employee benefits, and
as such, Operator, its agents and employees shall not be entitled to any County
employment benefits, such as, but not limited to, vacation, sick leave, insurance,
workers' compensation, or pension or retirement benefits.
8. Indemnity. To the extent permitted by law, Operator shall indemnify and hold the
County, its agents and employees, harmless against any and all claims, demands,
causes of action, or other liability, including attorneys' fees, on account of personal
injuries or death or on account of property damages arising out of or relating to the
work to be performed by Operator hereunder, resulting from the negligence of or
willful act or omission of Operator, its agents, employees and subcontractors. To
the extent permitted by law, the County shall indemnify and hold the Operator, its
agents and employees, harmless against any and all claims, demands causes of
action, or other liability, including attorneys' fees, on account of personal injuries
or death or on account of property damages arising out of or related to the solid
waste services operated and administered by the County, and resulting from the
negligence of or willful act or omission of the County, its agents, employees, and
subcontractors.
9. Business Auto Liability. Operator shall maintain applicable Business Liability and,
if necessary, Commercial Umbrella Liability insurance with a limit of not less than
$1,000,000 each accident. Such insurance shall cover liability arising out of any
auto, including owned, hired, and non -owned autos used in the performance of
work or services.
10. Assignment, Contracting_ The parties agree that this agreement is not transferable
or assignable by either party without the written consent of the other party to this
agreement. Operator shall not subcontract with another entity to perform the
services described herein without the approval of the County Manager or his
designee.
11. Termination. The franchisee may terminate this franchise upon three hundred
sixty-five (365) days written notice, or less notice with the consent of the County.
The County may only revoke the franchise for cause as set out in Chapter 44,
"Solid Waste," of the New Hanover County Code. This franchise may be modified
or revoked by the County in the event that an ordinance is passed by the Board of
Commissioners creating an exclusive franchise system for residential solid waste
collection in the unincorporated County.
12. Non -Waiver of Rights. It is agreed that County's failure to insist upon the strict
performance of any provision of this agreement or to exercise any right based upon

a breach thereof, or the acceptance of any performance during such breach, shall
not constitute a waiver of any rights under this agreement.
13. Equal Opportunity. In connection with the performance of this agreement,
Operator agrees not to discriminate against any employee or applicant for
employment because of race, religion, color, sex, age, disability, or national origin.
14. Entire Agreement. This agreement constitutes the entire understanding of the
parties with regard to the provision of solid waste collection and disposal. No
modification of rescission of this agreement shall be effective unless evidenced by
a writing signed by both parties to this agreement.
15. E-Verify Compliance. Operator shall fully comply with the U.S. Department of
Homeland Security employee legal status E-Verify requirements for itself and all
its subcontractors. Violation of the provision, unless timely cured, shall constitute
a breach of contract.

Morgan and I own and operate Avian Carting, LLC. In addition to running this start up, I am employed with
Duke Energy (16 years) in Wilmington as a Journeyman Lineman. I have a BS in Business from Saint Thomas
Aquinas College and am halfway through my MBA studies at The Citadel.
Initially, we intend to focus our efforts on the roll off dumpster market (10-20yd. containers) targeting
the removal of construction and demolition debris. My family owned and operated a disposal company
before selling the operation to Republic Services. This is where I gained my initial experience with solid waste
collection and equipment as well as environmental regulations. I have included a notarized statement from

BRIEF SUMMARY:
This grant will continue the current funding of the salary and fringe of the existing Forensic Laboratory
Chemist position, lab supplies and travel and training costs from October 1, 2022 to September 30, 2023.
The funding breakdown is as follows: salary and fringe for existing Forensic Laboratory Chemist is $72,152, supplies
and training/travel is $24,000, and the total grant request is $96,152 with no match required. Governor's Highway
Safety Program encourages extending the position beyond the grant cycle; however it is not mandatory. The Sheriff
has to re -apply each year for funding.

WHEREAS, the New Hanover County Sheriffs Office (herein called the "Agency") has completed an application

contract for traffic safety funding; and that New Hanover County Board of Commissioners (herein called the
(The Governing Body of the Agency)
"Governing Body") has thoroughly considered the problem identified and has reviewed the project as described in the contract;
THEREFORE, NOW BE IT RESOLVED BY THE New Hanover County Board of Commissioners IN OPEN

MEETING ASSEMBLED IN THE CITY OF Wilmington, NORTH CAROLINA, THIS 24th DAY OF JANUARY 2022, AS

1. That the project referenced above is in the best interest of the Governing Body and the general public; and

New Hanover Soil & Water Conservation District is seeking support to apply for funding to explore the needs of
support for urban agriculture. This includes small farms in an urban environment that may help relieve food deserts. As
COVID-19 has impacted the community in many ways, citizens have started growing and sourcing food locally. This
grant is to help identify the customer base for urban agriculture programs and what their needs may be. The grant
amount is $10,000. No additional funding is needed, only the support of staff time for the project.

Section 2: Explanation
BA 22-039 As North Carolina continues to address issues related to the COVID-19 public health crisis, the needs of
adults, children, youth, young adults, and families have increased. As a result of the state budget being passed, New
Hanover County has been allocated $1,303,546 to be used for energy assistance payments. These American Rescue
Plan Act (ARPA) funds will be used for a pandemic automatically authorized payment for households with children
ages 0-10, that are receiving food and nutrition services, and received money from the Low Income Energy
Assistance Program (LIEAP) last fiscal year (20-21). Automatically authorized payments will be generated based on
the household's primary heating source and not the household's income or available resources. Households will
receive $300 for wood, $400 for gas and $500 for electric. No county match is required.
Section 3: Documentation of Adoption
This ordinance shall be effective upon its adoption.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County, North

BRIEF SUMMARY:
The Board is being asked to approve a Memorandum of Understanding (MOU) with Cape Fear Resource Conservation
& Development to continue developing and assist with implementing the Pages Creek Watershed Restoration Plan. It
is standard operating procedure for Cape Fear Resource Conservation & Development to request a MOU with project
partners in their service area.
The purpose of the Pages Creek Watershed Restoration Plan is to collaboratively develop and submit a completed a
watershed restoration plan for the Pages Creek watershed in New Hanover County for approval by the NC Division of
Water Resources. The plan will be used to identify and find solutions for non -point source pollutants in the watershed.
Approval of the watershed restoration plan will allow the county to qualify for Federal EPA 319 grant funding
opportunities in the future. It is the intent of Soil and Water to pursue Federal funds to reduce pollutants with green
and gray infrastructure options.
The Pages Creek watershed is currently impaired under the US EPA Clean Water Act, and its shellfish waters are closed
due to elevated levels of bacteria above the state standard for Enterococci. Development of the watershed
restoration plan will make use of the Watershed EZ and Runoff Reduction Scenario tools from the North Carolina
Coastal Federation to quantify the stormwater volume reduction goals for the watershed and the benefits of potential
stormwater volume restoration practices distributed throughout the watershed. In simple terms, lower volumes of
water flowing off impervious surfaces equals less pollution. The goal is to increase water infiltration in the watershed.
Following the approval and adoption of the Pages Creek Watershed Restoration Plan, the New Hanover County Soil
and Water Conservation District and its partners, Cape Fear Resource Conservation & Development and Moffatt &
Nichol, will identify and prioritize targeted retrofit projects for implementation. The projects will be aimed at reducing
the impact of impervious surfaces by mimicking natural hydrology to reduce flooding and protect water quality.

MEMORANDUM OF UNDERSTANDING AND COOPERATIVE AGREEMENT

This Agreement is entered into as of January 2022, between Cape Fear Resource Conservation and
Development, Inc. hereinafter referred to as "CFRCD" and New Hanover County, NC Government hereinafter
referred to as the "County".
I. Purpose:
Both the County and CFRCD are to collaborate on "Pages Creek Watershed Restoration Plan"
hereinafter referred to as "Project".
The North Carolina Land and Water Fund, hereinafter referred to as "NCLWF", has awarded
CFRCD a total of $75,000, which will be coming to CFRCD to support this project. CFRCD and the
County are entering into this agreement in support of implementing the following grant in
support of the Pages Creek Watershed Restoration Plan.
o $75,000 — North Carolina Land and Water Fund
o Additional funding is actively being sought to be utilized for completion of the project
Benefits of Participation: Implementation of this agreement will assist CFRCD and the County to protect
and support conservation of the Pages Creek including.

Community education and outreach has been shown through NHC's efforts in other
coastal watersheds to be extremely influential in the success of water quality
improvement projects.
b. Participation will also increase the capacity of CFRCD to continue seeking grant funding and
corporate investments and sponsorships bringing greater awareness to the conservation needs of
Pages Creek.
III. Responsibilities:
A. CFRCD agrees to:
1. Complete the fiscal management for the Grants listed in Section 1. This includes
submitting necessary financial reports, tracking match dollars, paying all bills associated
with the project that are covered by the grants, and other requirements related to the
grants.
2. Appoint a project coordinator to ensure that the deliverables for each of the grants are
met.
3. Enter into additional contracts with other entities to complete project deliverables
Examples include contracting with various consulting companies to complete evaluation of
Pages Creek as well as engaging with Subject Matter Expert engineers to move forward on
"shovel -ready" projects to improve water management throughout the Pages Creek
Watershed.
4. Provide the County Manager and project steering committee with project and financial
updates.
5. Designate the following as the liaison between CFRCD and the County

IV. It is Mutually Agreed
A. Disputes and Conflict of Interest:
1. In case of disagreements, differences, or other concerns, the liaisons will work to resolve
these issues. If they are unable to resolve the differences, the County Commission
Chairperson and President of CFRCD will be informed and brought into the process.
2. If a resolution is not achieved, either party may request and be granted consultation from
a mediator selected and agreed to upon by both parties. If mediation is unsuccessful the
parties may agree to enter arbitration. The decision of the arbitrators will be final and
binding upon both CFRCD and the County.
3. Should a potential conflict of interest arise between CFRCD and the County during the
tenure of this agreement, the liaisons will immediately discuss the conflict.
B. This agreement may be amended in writing by mutual consent of the parties to this agreement.
C. The entire agreement between the County and CFRCD is contained within this document and its
appendices.

On 12/17/2021 New Hanover County received notification of an award from the Department of Justice, Office of
Justice Programs (OJP), Bureau of Justice Assistance 2021 Adult Drug Court and Veterans Treatment Court
Discretionary Grant Program. The funding ($349,439) will be used to establish a Veterans Treatment Court and pay for
the yearly annual cost of salary and benefits for a full-time Veterans Treatment Court Coordinator position to include
computer equipment set-up and training. Any remaining funds will be used to provide ancillary services to support
Veterans in their treatment. The coordinator will be the liaison between the court and community partner agencies,
including New Hanover County Veteran Services, with a primary focus of facilitating communication between team
members. Other duties would include screening potential Veterans Treatment Court participants for program eligibility,
preparation of the court docket, tracking of sanctions and incentives, facilitating team meetings, and data collection
and analysis. The award is for four years and would run through September 2025. A 25% in -kind county match is
required. Matching funds will come from existing staff time utilized to manage the grant. An additional 60 clients
(veterans with substance use and/or mental health diagnoses involved in the court system) will be served over the life
of the grant. The position will end when funding ends and existing office supplies and furniture will be utilized for this
position. Prior to the expiration of the grant, there will be an evaluation whether to continue funding the program with
local county funds.

To allow for the completion of the Blue Clay Road Business Park outside of ARPA funding, staff is
proposing to fund this project through debt that will be issued later in fiscal year 2022 along with other
projects authorized in the fiscal year 2022 budget to be funded through debt. With the addition of this
project, the County would remain in compliance with its debt capacity limit. A budget amendment is
included in the agenda item for approval to adjust the funding source of this project to loan proceeds.
Further, the County has a reserve of fund balance for future capital projects and capital outlay that staff is
proposing to use for capital related projects in the community violence plan. This amount totals $1,336,000
in fiscal year 2022 and a budget amendment is included in the agenda item for approval of the use of fund
balance for these items.
In addition, there are certain programs that are not proposed to be funded through fund balance as they
are not capital related nor are they being proposed to be funded through ARPA due to the type of program
and the limited funding that currently remains unallocated in ARPA. For those programs, staff is proposing
to use the interest and corpus of the Revenue Stabilization Fund. A budget amendment is included in the
agenda for the use of interest expected to be earned in fiscal year 2022 in the Revenue Stabilization Fund
to fund the fiscal year 2022 costs of these programs.

The expansion of the Elements program would allow for the NHC Sheriff’s Office to increase the capacity
of this evidence-based program to not only alleviate the current waitlist for children in need of the
service but also allow for additional children who may not currently be on the waitlist due to the known
capacity limitations of the program. The expansion includes seven (7) Youth Intervention Specialists and
three (3) Case Workers. Costs include salaries, benefits, vehicles, equipment, supplies, and one new
passenger van for group activities. Fiscal year 2021 includes one quarter of funding, with full year
funding through fiscal year 2025. These costs are eligible for ARPA funding to address educational
disparities as an evidence-based program that addresses social and emotional needs of students. ARPA
funding would be available for this program through June 30, 2024.

One element of the Community Care Coordination program is NHC’s version of Bull City United. This
violence interruption model will include a Director, Business/Data Analyst, three (3) Mediators, three (3)
Outreach Workers and one (1) Supervisor. Costs include salaries, benefits, equipment, and training.
These costs are eligible for ARPA funding to address disparities in public health outcomes through
evidence-based community violence programs to prevent violence. Using ARPA funding, these services
would need to be provided in a qualified census tract or in low-income areas designated by HUD. ARPA
would be available for this program through June 30, 2024.

Impact Zone Elementary School Resource Officers:
Elementary schools share school resource officers (SRO)and do not each have a dedicated SRO. Staff is
proposing to add four (4) SROs to have a dedicated SRO at each elementary school in the impact zone.

Community Care Coordination – Community Resource Coordinators:
The other element of the Community Care Coordination program is community resource coordination,
where students in need have one entry point to a variety of services that may be needed. These
coordinators will work with student and their families to identify and enter those students and their
families into the appropriate program given the student’s need. This program includes twenty (20)
resource coordinators that will serve seven (7) schools, one (1) Latin Community Resource Coordinator,
and one (1) supervisor. These services will be provided by a County selected non-profit(s). Cost
estimates include salaries, benefits, and equipment. The schools being served are Gregory Elementary,
Snipes Elementary, Forest Hills Elementary, Freeman Elementary, DC Virgo, Williston Middle School, and
New Hanover High School. These costs are eligible for ARPA funding to assist community members with
navigating and applying for available public benefits or services and to further the prevent an increase in
violence during the pandemic. Using ARPA funding, these services would need to be provided in a
qualified census tract or in low-income areas designated by HUD. ARPA would be available for this
program through December 31, 2024.

Community Call Center:
The creation of a community call center would create a unit to allow the public to call in information
related to a perceived threat, both in and out of school, research and respond to those threats and
monitor social media for potential threats of violence. The call center includes thirteen (13) individuals
including one supervisor, and four shifts of one (1) lead coordinator and two (2) monitors each. The four
shifts would allow the call center to be operated 24 hours a day. Cost estimates include salaries and
benefits, equipment, and operational/software costs. These costs will be paid for through the use of
appropriated fund balance.

320 Chestnut Street Upfit:
With various new programs and positions to be funded for community violence interruption, a space
must be provided to house these services and individuals. 5,100 square feet of the fourth floor of
County-owned building at 320 Chestnut Street will be upfitted to accommodate the new positions and
clients when needed. An estimated $173 per square foot cost is being estimated for an open floor plan
design and includes the furniture and fixtures for the building. As a capital cost, it is being
recommended that fund balance be used for this cost.

Boarding School Design:
The County is proposing to fund a new school operated by Leading Into New Communities (LINC) that
will concentrate on youth and young adults between the ages of 16 to 21 who have previous criminal
justice-involvement, gang involvement, on supervision, and/or those who have committed crimes. The
participants will be able to obtain their GED or high school diploma, will obtain vocation/trade
preparation and obtain technical training needed in order to perform particular jobs. The program for
each participant will last 10 to 14 months. Costs for fiscal year 22 include design.

Food Desert Grocery Store:
Currently there is a food desert on the north side of the down area. The County would like to partner
with a current grocery store operator to bring a grocery store option to that area. The County proposes
to design and build a grocery store and select a partner to operate the grocery store. The costs in the
model include the design and construction of a 6.000 square foot grocery store to be located on at least
2 acres of donated land and includes cost of a consultant to assist with operationalizing the grocery
store operations. As a capital cost, it is being recommended that fund balance be used for this cost.

BA 22-043 On October 18, 2021, the New Hanover County Board of Commissioners directed the County Manager and
staff to establish a new plan for the purpose of dealing with a community crisis and emergency by identifying
alternative funding sources and minimizing the use of funds that were established through the sale of New Hanover
Regional Medical Center. This amendment establishes a budget using funds from Appropriated Fund Balance from
the General Fund and Escrow Interest from the Revenue Stabilization Fund and allocates them for programmatic
operating costs to address the public health crisis and supporting behavioral health in the community. This budget
amendment allocates funding for the last three months of the current fiscal year. The funds will be strategically
invested in programs and initiatives to decrease the violence in our schools and community. A collaborative
community approach has been taken to identify gaps in schools and neighborhoods, and solutions needed to ensure the
safety of our schools and reducing violence among our youth.

BA 22-044 changes the funding source for the Blue Clay Road Business Park from American Rescue Plan Act
(ARPA) funding to loan proceeds. This reallocation allows this funding to be used toward community violence
prevention programs that are eligible for the county’s ARPA funding. To allow for the completion of the Blue Clay
Road Business Park outside of ARPA funding, staff is proposing to fund this project through debt that will be issued
later in fiscal year 2022 along with other projects authorized in the fiscal year 2022 budget to be funded through

What areas of concern would you like to see addressed by this committee?
I would like to see some equity issues that some entrepreneurs have shared with me be brought to the for front. I would like to
see more accessible for individuals that struggle to read.There are many standards for assess I lift online for our federal

I care deeply about supporting the marginalized,fighting against inequality and making sure that people know they are valuable
and worthy.
What areas of concern would you like to see addressed by this committee?
I don't know if these are issues addressed by CRAC, but off the top of my head,a few issues I see that are close to my heart are
closing the gap between kinship placement and foster care homes. Kinship placements do not receive the same protection,
services,financial assistance or support that foster care does and I believe it limits the amount of family or like family homes for
our 818 kids in out of home placements in the two nearest counties.Secondly,food deserts are only becoming a bigger issue as
food bank dry up unemployment continues and prices rise. I would love to see affordable shopping with fresh produce options
become a reality for our downtown community.Lastly, I think we could do better with community communication as far as
distribution of supplies,Christmas assistance,services provided,and education of the available resources. I feel I see a lot of
duplication of efforts which means a lot of assistance is being given but that it may not be being distributed to all those who are
in need of them.
Qualifications for serving:
While I don't have experience sitting on a committee like this, I believe that my heart for people and genuine desire to make
people feel loved and known qualifies me. I actually,as generic as it sounds,want to make the world a better place.And I
believe that the way to do that is one step at a time and I believe this is my next step.

I am the Southeast Coordinator for Recidivism Reduction Services working with clients in Brunswick, New Hanover and Pender

I would like to serve on the youth crime prevention board to assist with community knowledge of available resources in particular

I am the founder of Invisibility Project,a non profit organization devoted to using the creative arts to facilitate discussions about
race relations in Wilmington.The project provides training and support to the community to build authentic relationships across
differences. I also am a member of the New Hanover County Resiliency Task Force.
Why do you wish to serve on this board or committee?
I care deeply about the youth in the Wilmington Community and how community risk factors affect their lives. I have worked at
several different mental health agencies over the last ten years that have been focused on juvenile delinquency prevention and
have seen the strengths and weaknesses of the current efforts to address risk factors. I would like to be part of the solution on a
more direct level.
What areas of concern would you like to see addressed by this committee?
I would like to see the committee devise solid plans for addressing systemic factors that contribute to juvenile crime as well as
effective ways to involve youth in positive activities.
Qualifications for serving:
Over the course of my career I have worked in several settings and programs devoted to addressing juvenile crime. Previously,
when I lived in Boston, I provided mental health assessments at Boston Juvenile Court Clinic before working in independent
living programs focused on addressing and preventing sexual exploitation of youth(prostitution).
In Wilmington(where I have lived for the last 10 years), I have worked at PORT Health Services and Coastal Horizons Center
providing home based counseling focused on addressing risk factors within the family and community impacting our youth.
