The American Leadership Academy (ALA) Coastal is a tuition -free, non-profit PreK-9 charter school established in
2017 and located in New Hanover County.
ALA Coastal has requested a Deputy Sheriff -School Resource Officer position to provide law enforcement security,
serve as a mentor, and act as a liaison between school administration and the New Hanover County Sheriff's Office.
The Sheriff's Office would like to request a Deputy Sheriff position. This would be a revenue generated position.

BRIEF SUMMARY:
The Sheriff's Office would like to purchase six (6) 2022 Harley Davidson Motorcycles and trade-in with the purchase of
six (6) used 2019 Harley Davidson Motorcycles. NCGS 143-129.7 states "Notwithstanding the provisions of Article 12
of Chapter 160A of the General Statutes, municipalities, counties, and other political subdivisions of the State may
include in specifications for the purchase of apparatus, supplies, materials, or equipment an opportunity for bidders to
purchase as "trade-in" specified personal property owned by the municipality, county, or other political subdivision, and
the awarding authority may award a contract for both the purchase of the apparatus, supplies, materials, or equipment
and the sale of trade-in property, taking into consideration the amount offered on the trade-in when applying the
criteria for award established in this Article."
The county issued a Request for Bids (RFB) on August 3, 2022, for the purchase of the new motorcycles and detailing
an opportunity for bidders to purchase as "trade-in" the used motorcycles owned by the county. Bids were due on
August 11, 2022 at 2:30 pm. Only one bid was received and since there is no minimum number of bids that must be
received for a purchase contract regardless of the amount, the bid was opened and read aloud.

WHEREAS, NCGS 143-129.7 allowed the county to include in the specifications for the purchase of the

WHEREAS, Coastal Carolina Harley Davidson, the only bidder submitted a cost of $123,405.36 for the
purchase, installation of equipment, and document fees for the motorcycles less $68,994 for trade-in
value for a net cost of $54,411.36; and
WHEREAS, funds to cover the net cost of $54,411.36 are available in FY 2023 budget.
NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of Commissioners that the award
of contract to Coastal Carolina Harley Davidson for the purchase of six (6) 2022 Harley Davidson
motorcycles and the sale of six (6) 2019 Harley Davidson motorcycles is approved. Approval is given for
the net cost of $54,411.36 for the purchase and installation of equipment, and document fees. County

Second Reading: Approval of Solid Waste Franchise for Seahawk Sanitation, Inc.
BRIEF SUMMARY:
New Hanover County requires a county issued franchise to collect solid waste. Pursuant to County Ordinance 44.55,
the applicant has provided information about business organization, equipment, personnel, and fiscal
responsibility. The Environmental Management Director has no objections to the franchise request. The franchise
period would run for seven years.
All franchise agreements shall now include the following requirements: Should franchisee provide curbside collection
for services; franchisee must also offer customers a curbside recycling option.
Staff has reviewed only for compliance with the County Code. Prospective customers of any hauler must make their
own determination as to suitability of provider and services.
The first reading was approved unanimously on August 22, 2022.

New Hanover County Contract # 23-0045
STATE OF NORTH CAROLINA AWARD OF FRANCHISE AGREEMENT
FOR
COUNTY OF NEW HANOVER SOLID WASTE SERVICES
THIS FRANCHISE AGREEMENT made and entered into this the day of
2022, by and between NEW HANOVER COUNTY, North Carolina, a political
subdivision of the State of North Carolina, hereinafter called "County" and SEAHAWK
SANITATION, INC., a North Carolina Corporation, with its principal mailing address 7220
Verona Drive, Wilmington, North Carolina 28411-7394, hereinafter called "Operator."
WITNESSETH
WHEREAS, the County has, through the power granted to it under G.S. 153A-136,
adopted an ordinance regulating the collection and disposal of solid wastes and requiring that
all waste haulers have a license and a franchise in order to operate in the County, in order to
provide the residents and commercial customer of the County with reliable, environmentally
sound waste disposal now and in the future; and
WHEREAS, Operator has contracted with commercial and/or residential customers
located in New Hanover County in order to provide solid waste collection and disposal; and
NOW THEREFORE, in consideration of the mutual benefits inuring to the parties
hereto and based upon the mutual covenants contained herein and the considerations stated
herein, the parties do hereby covenant and agree, and County hereby conveys a non-
exclusive franchise to Operator, to collect and dispose of solid wastes to commercial and/or
residential customers in the County. The parties therefore agree to the following terms and
conditions:
Terms of Agreement. The initial term of this Franchise Agreement shall be seven
(7) years from the date of signing. The Franchise may automatically renew and
extend for a subsequent seven (7) year term, contingent upon County
Commissioners approval pursuant to G.S. 153A-46.
2. Scope of Services. For the term of this Franchise Agreement, Operator agrees to
provide commercial and/or residential customers with solid waste collection and
transportation to County -approved disposal sites.
3. Disposal at County -Approved Facilities. Operator agrees to dispose of all waste
collected in the County, as part of this franchise agreement, at County -approved
facilities consistent with State law. With regard to County -approved facilities, said
approval must be obtained by Operator prior to the disposal at said facilities, and
said approval shall be granted or denied entirely at the discretion of the County.
The County also has the authority to designate which facilities shall be used.
4. Curbside Recycling. Should Operator provide curbside trash collection services,
Operator must also offer customer a curbside recycling option.
5. Administration/Billing. All billing of customers shall remain the responsibility of the
franchisee.

6. Franchise. It is understood and agreed that all of the terms and conditions of New
Hanover County Code Chapter 44, entitled "Solid Waste," pertaining to a franchise
for solid waste collections are incorporated herein by reference and made a part
hereof as if fully set forth, including but not limited to insurance requirements.
7. Personnel and Equipment. Operator shall equip and maintain all vehicles with staff
and equipment to comply with any applicable regulations and laws.
8. Independent Contractor. It is mutually understood and agreed that Operator is an
independent contractor and not an agent of the county, and as such, Operator, its
agents and employees shall not be entitled to any County employee benefits, and
as such, Operator, its agents and employees shall not be entitled to any County
employment benefits, such as, but not limited to, vacation, sick leave, insurance,
workers' compensation, or pension or retirement benefits.
9. Indemnity. To the extent permitted by law, Operator shall indemnify and hold the
County, its agents and employees, harmless against any and all claims, demands,
causes of action, or other liability, including attorneys' fees, on account of personal
injuries or death or on account of property damages arising out of or relating to the
work to be performed by Operator hereunder, resulting from the negligence of or
willful act or omission of Operator, its agents, employees and subcontractors. To
the extent permitted by law, the County shall indemnify and hold the Operator, its
agents and employees, harmless against any and all claims, demands causes of
action, or other liability, including attorneys' fees, on account of personal injuries
or death or on account of property damages arising out of or related to the solid
waste services operated and administered by the County, and resulting from the
negligence of or willful act or omission of the County, its agents, employees, and
subcontractors.
10. Commercial General Liability. Franchise shall maintain Commercial General
Liability (CGL) and if necessary, Commercial Umbrella Liability (CUL) insurance
with a total limit of not less than $1,000,000 for each occurrence for bodily injury
and property damage. If such CGL insurance contains a general aggregate limit,
it shall apply separately to this work or services, or the general aggregate shall be
twice the required limit.
11. Business Auto Liability. Operator shall maintain applicable Business Liability and,
if necessary, Commercial Umbrella Liability insurance with a limit of not less than
$1,000,000 each accident. Such insurance shall cover liability arising out of any
auto, including owned, hired, and non -owned autos used in the performance of
work or services.
12. Assignment, Contracting. The parties agree that this agreement is not transferable
or assignable by either party without the written consent of the other party to this
agreement. Operator shall not subcontract with another entity to perform the

13. Termination. The franchisee may terminate this franchise upon three hundred
sixty-five (365) days written notice, or less notice with the consent of the County.
The County may only revoke the franchise for cause as set out in Chapter 44,

"Solid Waste," of the New Hanover County Code. This franchise may be modified
or revoked by the County in the event that an ordinance is passed by the Board of
Commissioners creating an exclusive franchise system for residential solid waste
collection in the unincorporated County.
14. Non -Waiver of Rights. It is agreed that County's failure to insist upon the strict
performance of any provision of this agreement or to exercise any right based upon
a breach thereof, or the acceptance of any performance during such breach, shall
not constitute a waiver of any rights under this agreement.
15. Equal Opportunity. In connection with the performance of this agreement,
Operator agrees not to discriminate against any employee or applicant for
employment because of race, religion, color, sex, age, disability, or national origin.
16. Entire Agreement. This agreement constitutes the entire understanding of the
parties with regard to the provision of solid waste collection and disposal. No
modification of rescission of this agreement shall be effective unless evidenced by
a writing signed by both parties to this agreement.
17. E-Verify Compliance. Operator shall fully comply with the U.S. Department of
Homeland Security employee legal status E-Verify requirements for itself and all
its subcontractors. Violation of the provision, unless timely cured, shall constitute
a breach of contract.

I hope you are doing well! I have gathered the necessary information that is listed online to apply for a Franchise
Agreement for New Hanover County. I have pasted the needs below and have provided my answers in red. I have also
attached my business plan to this email that answers the majority of the questions/needs and I have also attached the
projections that I have put together to show the projected financial performance
1.Name and address of applicant and whether a sole proprietorship, corporation, or partnership, with
disclosure of the ownership interests. - Jordan Cordero is the applicant. I will be creating an LLC for
the business and will own the majority share. I plan to give Drew Williams (less than 10%) equity in the
business to provide him with some incentive as the business ramps up.
2.A list of the equipment possessed, available, or to be obtained within 18 months by the applicant. - In

3.Number of employees the applicant expects to use in said business. - 3 total employees until the
business has 793 cans out - Jordan, Drew and 1 FT Admin who is answering calls and setting up
service for customers.
4.Experience of the applicant in solid waste collection. - Resume is attached to the business plan. I do
not have ownership experience tied directly to solid waste collection but I have a close friend who
runs/operates a trash company in Jacksonville NC and has about 7 trucks with 8000 residential cans
out. He has helped me during my research. I personally have a background in finance and my resume
in the business plan gives an overview of my experience during my career.
5.Balance sheet or equivalent financial statement prepared by a certified public accountant or other
person satisfactory to the board as of the close of the applicant's last business year, showing the net
worth of the business. All financial data submitted in compliance with the requirements of this
paragraph shall be confidential under G.S. 132-1.2, and shall not be regarded as public information. In
lieu of the financial statement, the county will accept a notarized statement from a certified public
accountant verifying the financial viability of the applicant business. - I have attached the SBA
413. This is a government form that all SBA lenders require a customer to fill out when applying for
financing. This is not CPA certified but I am happy to provide verification of all assets that are listed on
the form if needed.

The North Carolina Association of County Commissioners (NCACC) annual Legislative Conference will be held
November 16 and 17, 2022 in Raleigh. Counties are invited to submit proposed additions to the NCACC list of
statewide legislative priorities to consider at the conference.
New Hanover County's proposals include advocacy for transportation infrastructure, beach nourishment, PFAS

RESOLUTION DETAILING NEW HANOVER COUNTY SUGGESTED LEGISLATIVE PRIORITIES FOR THE
NORTH CAROLINA ASSOCIATION OF COUNTY COMMISSIONERS
WHEREAS, New Hanover County is a member of the North Carolina Association of County Commissioners
(NCACC); and
WHEREAS, the NCACC asks member counties to submit legislative priorities for the statewide organization
to adopt as strategic and advocacy goals; and
WHEREAS, the New Hanover County Board of Commissioners has identified several goals worthy of
inclusion among the NCACC list of legislative priorities; and
WHEREAS, the Board supports NCACC advocacy for recurring funding solutions to support transportation
infrastructure beyond the gasoline tax; and
WHEREAS, the Board supports NCACC advocacy to support legislation to hold chemical manufacturers of
emerging contaminants that include perfluorooctanoic acid (PFOA), perfluorooctanesulfonic acid (PFOS),
and other per- and polyfluoroalkyl substances (PFAS) who then pollute drinking water sources financially
responsible for cleanup and mitigation efforts; and
WHEREAS, the Board supports NCACC advocacy to identify a recurring source of funding for the state's
Coastal Storm Damage Mitigation Fund, recognizing that residents throughout the state's 100 counties
own property along the coast of North Carolina; and
WHEREAS, the Board supports NCACC advocacy for increased state funding to fully support drug
treatment courts and other specialty courts, recognizing that treatment courts are an extension of the
judicial system and the state has the primary duty to fund the court system.

BRIEF SUMMARY:
The North Carolina Department of Environmental Quality (DEQ) Division of Water Infrastructure has announced
applications for water/wastewater/stormwater funding for the Fall 2022 funding round. The fund has $82 million in
grant funding available for eligible stormwater projects. There is no local match required. Applications are due
September 30, 2022 and awards determined in February 2023. All funds must be expended by December 31, 2026.
Per the announcement:
"The American Rescue Plan Act (ARPA) State Fiscal Recovery Fund (SFRF) will provide 100 percent grant funding for
stormwater projects through the Local Assistance for Stormwater Infrastructure Investment (LASII). Funding is
available to cities or counties, and regional Councils of Government and non-profit entities partnering with cities and
counties, to improve or create infrastructure for controlling stormwater quantity and quality. This is the first funding
application round ARPA Stormwater grants have been available. The finalized ARPA administration plan for
stormwater funding will be available during Fall 2022 application training and online.
Stormwater funding is available for:
Planning grants: to conduct research or investigative studies, alternatives analyses, the preparation of engineering
concept plans or engineering designs, and similar activities intended to help an eligible entity determine the best
solutions for the entity's stormwater quality or quantity issue and to engineer and permit the solutions. Nature -based
solutions are also allowed.
Construction grants: to develop and implement a new stormwater utility or stormwater control measure (SCM), the
rehabilitation of existing SCMs, the retrofitting of existing stormwater conveyances to provide SCMs for quantity and
quality control purposes, the installation of innovative technologies and/or nature -based solutions."
Staff has attended the online webinar training and the form to request funding will be completed in its entirety online.
A resolution from the Board of County Commissioners must accompany the online application to apply for funding. A
list of possible planning and construction projects has been compiled by Stormwater Services and is attached for
reference. Staff will submit detailed project plans to accompany the application for funding per the grant guidelines.

WHEREAS, New Hanover County has need for and intends to construct, plan for, or conduct a study on the following

BRIEF SUMMARY:
In June, staff presented an update from the stakeholder group established to create a detailed strategy to address
Mental Health and Substance Use Disorders in New Hanover County. This group met eight times over the course of
five months to review data, understand trends, listen to consumers of mental health and substance use disorder
services and meet with representatives from the North Carolina Association of County Commissioners and the North
Carolina Department of Health and Human Services Secretary, Kody Kinsley. This robust process has provided the
opportunity to build awareness and understanding of the complexity of addressing mental health and substance use
disorders and alignment with potential partners. Based on this process, staff has prepared the attached Strategic Plan
for Mental Health and Substance Use Disorders to guide the disbursement of funding.
The attached plan outlines three focus areas with their associated desired outcome and key performance indicators to
ensure accountability for goals being achieved. These focus areas include education and outreach, access to services
and treatment and sustainable recovery and wellbeing.
As a part of the strategic planning process, this group of stakeholders also began identifying key investments to help
advance the strategy and ensure successful outcomes for the community.
This strategy and recommendations are intended to guide the disbursement of the $50 million Mental Health and
Substance Use Disorder Fund and the first five years of the opioid settlement funds totaling approximately $8.5 million
over the first five years and a total of $18.4 million over an 18-year period.
It will be important to review the established key performance indicators on an annual basis to ensure the initiatives
identified are achieving their goals. Staff is prepared to provide these updates in collaboration with the New Hanover
County budget process.

BRIEF SUMMARY:
Planning & Land Use, in coordination with Parks & Gardens, desires to apply for the STBGP-DA fund in the amount of
$461,949 to ensure that a 10-foot multi -use path is included in NCDOT's W-5703C Monkey Junction Pedestrian
Improvement Project. New Hanover County would provide the required local cash match of $115,488, for a total
project cost of $577,437.
This project was envisioned approximately six years ago in response to a large number of pedestrian deaths and
injuries in the Monkey Junction area. In January 2017, New Hanover County committed to ongoing maintenance of
the pedestrian facilities included in the project, which at the time, included sidewalks on both sides of Carolina Beach
Road/U.S. 421 and signalized crosswalks.
The current design for the project includes curb and gutter along both sides of U.S. 421 from Antoinette Drive to
Willoughby Park Court; a 10-foot multi -use path on the east side of U.S. 421; a sidewalk on the west side of U.S. 421;
a black aluminum fence in the existing median along the project corridor; and pedestrian signals, high -visibility
crosswalks, and lighting at the intersections of U.S. 421 at Antionette Drive and the northernmost Walmart driveway.
The sidewalk on the east side of the roadway was replaced with a 10-foot multi -use path to reflect long term bicycle
and pedestrian plans in this area.
Due to rise in construction costs, the federal funding allocated to this project is no longer sufficient to cover the cost of
the 10-foot multi -use path. The current estimated shortfall is $577,437, and the STBGP-DA fund is the only available
source of additional funding. Because both the fund and the pedestrian project use federal sources, a local source --
New Hanover County --would be required to provide the match for the grant, if approved. Without the additional
funding to cover the shortfall, the project would be completed with a sidewalk on the east side of U.S. 421, which is
not aligned with the bicycle and pedestrian plans for this area and may require additional investment by the county to
upgrade the sidewalk to a multi -use path in the future.
The required grant match is not currently budgeted for FY 22-23, so staff will coordinate with NCDOT and the WMPO,
if the grant is awarded, to allocate the funds in FY 23-24.

GRANT PROGRAM -DIRECT ATTRIBUTABLE FUNDS
WHEREAS, the Wilmington Urban Metropolitan Planning Organization (WMPO) will be awarding
approximately $5,088,395 in funding through their Surface Transportation Block Grant Program -Direct
Attributable (STBGP-DA) competitive grant process which requires a local cash match of 20%; and
WHEREAS, the New Hanover Planning and Land Use Department, in coordination with Parks and Gardens,
wishes to apply for funding through the Federal Surface Transportation Block Grant Program -Direct
Attributable (STBGP-DA) fund for construction of a 10-foot multi -use path (MUP) on the east bound side
of U.S. 421/Carolina Beach Road as part of the Monkey Junction Pedestrian Improvement Project; and
WHEREAS, these improvements together with lighting and pedestrian signals, will augment the ease of
pedestrian movement and address safety concerns for citizens at one of the most heavily traversed
intersections on U.S. Hwy. 421; and
WHEREAS, the maximum federal funding which is allocated to NCDOT for this project can only fund a
sidewalk on the eastern side of U.S. 421, which is not in alignment with long-term bicycle and pedestrian
plans for this area, the county, NCDOT and the Wilmington Metropolitan Planning Organization (WMPO)
are in agreement that the upgrade to a 10-foot MUP on the east side of the roadway is the preferred
functional, design option at the location; and
WHEREAS, the multi -use path would provide connection to the high -visibility crosswalks at the
intersection of U.S. 421 with Antoinette Drive and the northernmost access at Walmart.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby
authorizes the Planning and Land Use Department to apply for the STBGP-DA fund in the amount of
