Adoption of a Resolution of Support for East Coast Greenway Grant Application
BRIEF SUMMARY:
The East Coast Greenway Alliance, including the Town of Kure Beach, is applying for a grant, estimated to be between
$80,000 to $120,000, from the North Carolina Department of Transportation to fund a feasibility study of improving
the greenway through bicycle and pedestrian connections, including through Kure Beach and Fort Fisher. The Town of
Kure Beach is requesting a resolution of support for the grant application. The alliance and the town are not requesting
a financial contribution from New Hanover County.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION SUPPORTING THE EAST COAST GREENWAY'S APPLICATION TO THE NORTH CAROLINA
DEPARTMENT OF TRANSPORTATION FOR THE INTEGRATED MOBILITY DIVISION FEASIBILITY STUDY
GRANT PROGRAM TO COMPLETE A FEASIBILITY STUDY FOR THE PLEASURE ISLAND GREENWAY IN
KURE BEACH AND FORT FISHER
WHEREAS, the North Carolina Department of Transportation's Integrated Mobility Division seeks to
bridge the gap between conceptual planning and programming of projects, build upon higher -level
planning efforts, and take a comprehensive approach to identify possible route alternatives of multimodal
corridors; and
WHEREAS, to encourage the development of feasibility studies the North Carolina Department of
Transportation has created a grant program to fund plan development; and
WHEREAS, the Feasibility Study Grant Program seeks to create plans that include planning level
considerations for the study area such as demographics, existing and future land uses, the natural
environment, the human environment, producing a final analysis of alternative route alignments; and
WHEREAS, New Hanover County supports the planning and construction of trails and sidewalks; and
WHEREAS, the East Coast Greenway traverses our region, including an alignment through Kure Beach and
Fort Fisher, connecting to Southport via the Fort Fisher Ferry; and
WHERAS, the Town of Kure Beach recently adopted its Bicycle and Pedestrian Plan recommending a
bicycle and pedestrian connection to the Fort Fisher Ferry and surrounding destinations; and
WHEREAS, a feasibility study would improve the pipeline of this project to access state and federal funding
and produce a well -conceived project with demonstrated community support that will be competitive in
the State Transportation Improvement Program (STIP) and for federal investment; and
WHEREAS, the North Carolina Department of Transportation is accepting proposals for the Integrated
Mobility Division Feasibility Study Grant Program until January 9, 2023.
NOW THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners supports an
application by the East Coast Greenway to the North Carolina Department of Transportation for the
Integrated Mobility Division Feasibility Study Grant Program for a feasibility study along the Island
Greenway in Kure Beach and Fort Fisher.

Final Approval for Authority to Purchase Property Located at 1605 Robin Hood Road, Wilmington
BRIEF SUMMARY:
At the September 19, 2022 Board of Commissioners Meeting, the board provided the authority to purchase the land
and building located at 1605 Robin Hood Road, Wilmington for the purpose of establishing a medical detox and crisis
stabilization facility. The County has been without such a facility since The Harbor closed in 2021. This location is near
the hospital and is the site of a former senior rest home called Sherwood Manor.
The building has approximately 13,900 square feet, which would potentially include 16 beds for detox services and 20
beds for transitional housing. After an acquisition of this property, it is expected that the county would coordinate with
Trillium, LI NC and RHA Health to plan for renovations to the property and to structure the logistics of its operations.
The authority to purchase the property was at a price not to exceed $1.65 million, subject to receipt of a satisfactory
appraisal and a building condition assessment.
An appraisal of the property has been received, which indicates a value of $1.49 million, or 9.7% lower than the
proposed purchase price. This compares to the property tax value of $2.1 million.
A building condition assessment has also been received, which, as expected, indicates that significant renovations are
necessary. The estimated cost to renovate the building for its intended purpose is $6.1 million, with Trillium/RHA
expected to contribute $1.5 million and LINC expected to contribute $900,000 of those costs. If the purchase of this
property is completed, it is anticipated that staff will recommend at a future meeting that the county's estimated $3.7
million portion of the renovation costs be funded with existing funds in the Mental & Behavioral Health Fund.
If today's motion is passed and the contingencies are resolved, the anticipated closing date is on or before March 1,
2023.

Approval of Lease Agreement with Cape Fear Community College for Property Located at 319 North Third Street
BRIEF SUMMARY:
On February 3, 2023, the county is expected to complete the purchase of the property located at 319 North Third
Street, which includes 1.92 acres of land and a 5-story 55,000 square foot building, at a cost of $11,875,000. Subject to
acceptable due diligence, which has now been substantially completed, in October 2022 the board approved the
purchase upon receiving a request from Cape Fear Community College (CFCC) that the county consider the purchase
of this property to provide CFCC with the ability to expand its nursing and other allied health programs. Like the rest of
the nation, the county is experiencing nursing shortages. With an expansion to CFCC's nursing program, along with
developing more allied health professionals, it was concluded that the purchase of this building would be a positive
step in the future health care of the county's citizens, as well as providing the private sector with talent to fill higher -
wage jobs.
Upon the purchase of the building, it is proposed that the county and CFCC enter into a lease of the property. A full
draft of the lease agreement is attached for review, with significant terms including:
• A term of approximately nine and one-half years, from February 20, 2023 to July 31, 2032.
• Annual lease payments of $1.00 per year.
• The property is required to be used for the purpose of enhancing CFCC's nursing and allied health instructional
progra ms.
• CFCC will remit the "net rent proceeds" related to tenants currently in the building, with net rent proceeds
generally meaning the rent collected by CFCC, less expenses incurred in the operation and management of the
property.
• Once the rent proceeds are inadequate to satisfy the operating costs of the property, the county will comply
with NC General Statutes to ensure CFCC has adequate funds to meet its financial needs for the operation of
the property.
• The county will be responsible for major repairs, replacements, and other capital expenditures.
• A without cause, termination for convenience provision effective upon 365 days prior written notice, provided
that CFCC shall be entitled to complete any teaching program that is in process as of the notice of termination,
not to exceed two years from the notice of termination.
The lease must also be approved by the State Board of Community Colleges prior to execution, which is expected to
occur on February 19, 2023.
Consistent with an interlocal agreement that was approved by the board in November 2022, it is anticipated that upon
satisfaction of financing associated with the purchase of the building that the county will convey the property to CFCC,
provided that the property is being used as intended.

STATE OF NORTH CAROLINA
LEASE AGREEMENT
COUNTY OF NEW HANOVER
THIS LEASE AGREEMENT made and entered in this day of January
2023 by and between the County of New Hanover, hereinafter referred to as the
"COUNTY," and the The Trustees of Cape Fear Community College, hereinafter
referred to as the "LESSEE."
WITNESSETH:
WHEREAS, the COUNTY owns property situated at 319 North Third Street, City
of Wilmington, tax parcels, R04817-001-015-000, R04817-001-004-000 and R04817-
001-012-000 (the "Leased Premises");
WHEREAS, the LESSEE has requested the execution of this instrument and the
use of the Leased Premises for the purpose of enhancing its nursing and allied health
instructional programs;
WHEREAS, the parties hereto have mutually agreed to the terms of this Lease
Agreement ("Agreement') as hereinafter set out.
NOW, THEREFORE, in consideration of the promises and covenants contained
in the terms and conditions hereinafter set forth, the COUNTY does hereby lease the
Leased Premises and all improvements situated thereon unto the LESSEE for and
during the term and under the terms and conditions hereinafter set forth, with all rights,
privileges and appurtenances thereto belonging, lying and being in the County of New
Hanover, North Carolina.
1. TERM. This LEASE shall commence on the 20th day of February 2023, and
unless sooner terminated or extended as hereinafter provided, shall exist and
continue until July 31, 2032.
2. PAYMENT. As payment for the premises heretofore described, the LESSEE
agrees to pay an annual sum of one ($1.00) Dollar. Such payment shall be made
to the New Hanover County Finance Office, 230 Government Center Drive, Suite
165, Wilmington, North Carolina, 28403.
3. USE. Subject to the rights of other existing Tenants in the Leased Premises, the
LESSEE will use the Leased Premises only for the purpose of enhancing its
nursing and allied health instructional programs and for no other purpose without
the written consent of the COUNTY.
4. ASSIGNMENT OR SUB -LEASE. There are existing tenants in Leased
Premises. Pursuant to that Interlocal Agreement of or about even date herewith,

LESSEE shall administer all leases with third -party tenants and remit to the
COUNTY any net rent proceeds. "Net rent proceeds" as used herein shall mean
the gross rent collected by the College on behalf of the County less any and all
expenses incurred in the operation and management of the Property, including
but not limited to utilities, landscaping, maintenance and repair of all common
area, taxes, if any, and insurance. As and when spaces become vacated by the
existing tenants, LESSEE shall have the exclusive use of such spaces. LESSEE
acknowledges that some third -party tenants have the right to renew or extend the
terms of their leases, and that the COUNTY may not be able to control when a
currently -occupied space becomes available. Otherwise, the LESSEE shall not
assign or sublet this Agreement without the written consent of the COUNTY.
5. INDEMNITY. To the extent permissible by law, LESSEE, its successors and
assigns, shall indemnify and hold COUNTY, its officers, officials, agents and
employees, harmless against and any all claims, demands, causes of action, or
other liability, including attorney fees, on account of contract or personal injuries
or death or on account of property damages arising out of or relating to the
property leased hereunder, resulting from the negligence of or the willful act or
omission of LESSEE, its officers, officials, agents, invitees, contractors, and
employees.
6. UTILITIES AND OTHER OPERATING EXPENSES. The LESSEE shall be
responsible for all utilities (electricity, natural gas, water, sewer) related to use of
the Leased Premises, as well as, and not limited to, internet, phone, trash
collection, recycling, landscaping, security, and ongoing maintenance and routine
upkeep. LESSEE shall pay such amounts out of the rent proceeds it collects from
existing tenants. The parties acknowledge that at some point the Leased
Premises will only be occupied by LESSEE and in that case, or in any case
where LESSEE's utilities and operating expenses exceed the amount of rent
collected from third -party tenants, COUNTY will comply with N.C.G.S. Sec.
115D-32, following regular established budget processes, to ensure LESSEE has
adequate funds to meet its financial needs for these expenses.
7. ALTERATIONS AND PARTITIONS. The LESSEE may make reasonable
alterations and partitions to the Leased Premises and on or within the building of
the Leased Premises to enhance its suitability for the uses contemplated in this
Agreement, provided that prior written approval of plans for such alterations and
partitions shall be obtained from the COUNTY, which shall not unreasonably
withhold such approval. Pursuant to the aforementioned Interlocal Agreement,
LESSEE and COUNTY acknowledge and agree that the COUNTY intends to
renovate the Leased Premises pursuant to plans agreed upon between the
parties, and the parties shall cooperate with each other in furtherance thereof.
8. PERSONAL PROPERTY AND IMPROVEMENTS. Any additions, fixtures, or
improvements placed or made by the LESSEE in or upon the Leased Premises,

which are permanently affixed to the Leased Premises and which cannot be
removed without unreasonable and irreparable damage to said Premises, shall
become the property of the COUNTY and remain upon the premises as a part
thereof upon the termination of this Agreement. All other additions, fixtures, or
improvements, to include trade fixtures, office furniture and equipment, and
similar items, which can be removed without irreparable damage to the Leased
Premises shall be and remain the property of the LESSEE and may be removed
from the Leased Premises by the LESSEE upon the termination of this
Agreement, provided that the LESSEE shall bear the expense of any repairs to
the Leased Premises for damages, other than fair wear and tear, caused by such
removal. Any personal property located at the Leased Premises that is the
property of the COUNTY shall remain the property of the COUNTY unless
otherwise sold or disposed of.
9. MAINTENANCE. Subject to Sections 4 and 6 above regarding the use of rent
proceeds and the COUNTY's obligations under N.C.G.S. Sec. 115D-32, the
LESSEE is responsible for all general maintenance of the Leased Premises.
LESSEE agrees that it will, during the term of this Agreement, maintain and keep
its facilities in a safe, workable, clean and sanitary condition, and in good repair.
LESSEE agrees to furnish its own janitor service and safeguard all installed
equipment in respect to the buildings.
10. MAJOR REPAIRS. The COUNTY shall be responsible for major repairs
(including but not limited to repairs to the roof, exterior walls, and foundations),
replacements and other capital expenditures, including restoration after any
casualty loss.
11. TERMINATION.
a. If the LESSEE shall fail to pay any installment of rent when due and
payable as heretofore provided or fail to perform any of the terms and
conditions heretofore set forth and shall continue in such default for a
period of thirty (30) days after written notice of default, the COUNTY, at its
option, may terminate this Agreement and take possession of the Leased
Premises without prejudice to any other remedies provided by law. It is
provided, however, that no default shall exist if the LESSEE has
commenced reasonable efforts to cure such default within such thirty (30)
day period and continues such efforts with reasonable diligence.
b. If the COUNTY shall fail to perform any of the terms or conditions
heretofore set forth and shall continue in such default, for a period of thirty
(30) days after written notice of default, the LESSEE, at its option, may
terminate this Agreement and vacate the Leased Premises without further
obligation to pay rent as heretofore provided from date of said termination,
without prejudice to any other remedies provided by law. It is provided,

however, that no default shall exist if the COUNTY has commenced
reasonable efforts to cure such default within such thirty (30) day period
and continues such efforts with reasonable diligence.
c. Termination for Convenience. Either party may terminate this Agreement
at any time and without cause upon three hundred sixty five (365) days
upon written notification to the other of its intent to terminate, subject to
the "teach out" of a program cohort by LESSEE not to exceed 2 years (in
other words, if a program cohort offered by LESSEE lasts beyond the date
of a notice of termination by the COUNTY, LESSEE shall be entitled to
complete the program and this Agreement shall not be considered
terminated until completion of the program, but no longer than 2 years
after the notice of termination).
12. INSURANCE.
The following insurance shall provide coverage against claims for injuries to
persons or damages to property which may arise from operations or in
connection with the performance of the work hereunder by the LESSEE, its
officers, officials, agents, and employees, whether such operations by itself or
anyone directly or indirectly employed by it.
Commercial General Liability:
a. LESSEE shall maintain Commercial General Liability (CGL) and if
necessary, Commercial Umbrella Liability (CUL) insurance with a
total limit of not less than $1,000,000 each occurrence for bodily
injury and property damage. If such CGL insurance contains a
general aggregate limit, it shall apply separately to this
project/location or the general aggregate shall be twice the required
limit.
b. CGL insurance shall be written on Insurance Services Office (ISO)
"occurrence" form CG 00 01 covering CGL or its equivalent and
shall cover the liability arising from premises, operations,
independent contractors, products -completed operations, personal
and advertising injury, and liability assumed under an insured
contract including the tort liability of another assumed in a business
contract.
c. COUNTY, its officers, officials, agents, and employees are to be
covered as additional insureds under the CGL by endorsement CG
20 10 11 85 or CG 20 10 10 93 AND CG 20 37 10 01 or CG 20 37
10 01 or an endorsement providing equivalent coverage as
respects to liability arising out of activities performed by or on

behalf of the LESSEE; products and completed operations of the
LESSEE; premises owned, leased or used by the LESSEE; and
under the commercial umbrella, if any. The coverage shall contain
no special limitations on the scope of protection afforded to
COUNTY, its officers, officials, agents, and employees.
d. LESSEE's CGL insurance shall be primary as to respects to
COUNTY, its officers, officials, agents, and employees. Any other
insurance or self-insurance maintained by COUNTY, its officers,
officials, agents, and employees shall be in excess of and shall not
contribute to LESSEE's insurance.
Workers' Compensation and Employer's Liability:
a. LESSEE shall maintain Workers' Compensation as required by the
general statutes of the State of North Carolina and Employer's
Liability Insurance.
b. The Employer's Liability, and if necessary, CUL insurance shall not
be less than $1,000,000 each accident for bodily injury by accident,
$1,000,000 each employee for bodily injury by disease, and
$1,000,000 policy limit.
c. The insurer shall agree to waive all rights of subrogation against
COUNTY, its officers, officials, and employees for losses arising
from work performed by the LESSEE for COUNTY.
Business Auto Liability:
a. LESSEE shall maintain Business Auto Liability and, if necessary,
CUL insurance with a limit of not less than $1,000,000 each
accident.
b. Such insurance shall cover liability arising out of any auto, including
owned, hired, and non -owned autos.
c. Business Auto coverage shall be written on ISO form CA 00 01, or
a substitute form providing equivalent liability coverage. If
necessary, the policy shall be endorsed to provide contractual
liability coverage equivalent to that provided in ISO form CA 00 01.
d. The LESSEE's Business Auto Liability insurance shall be primary
as to respects to COUNTY, its officers, officials, agents, and
employees. Any other insurance or self-insurance maintained by

15. Memorandum of Lease. Upon demand by either party, COUNTY and LESSEE

AND ENCAPSULATION OF REGISTER OF DEEDS MAPS
WHEREAS, North Carolina General Statute 132-7 provides that Board of County Commissioners of
any county may authorize that any county records in need of repair, restoration or rebinding be
removed from the building or office in which such records are ordinarily kept, for the length of time
required to repair, restore, or rebind them; and

does hereby authorize and sanction the New Hanover County Register of Deeds office to remove
the records identified from the New Hanover County Registry for the purposes of repair,
restoration, and encapsulation by Kofile Preservation.

AGREEMENT
THIS CONTRACT made and entered into this day of
202 z. by and between NEW HANOVER COUNTY, a
political subdivision of the State of North Carolina, hereinafter referred to as "County";
and KOFILE TECHNOLOGIES, INC., a Delaware Corporation, hereinafter referred to as
"Contractor."
WITNESSETH:
That the Contractor, for the consideration hereinafter fully set out, hereby
agrees with the County as follows-
1 . Scope of Services. Contractor shall provide record restoration,
preservation, and conservation services for volumes of the New Hanover County
permanent record books located in the New Hanover County Register of Deeds Office,
320 Chestnut Street, Wilmington, North Carolina, as more specifically described in Exhibit
A, attached hereto, and incorporated herein by reference.
2. Time of Performance. The term of this Agreement shall begin from
receipt of Notice to Proceed, and all work shall be completed by June 30, 2023.
3. Pint. County hereby agrees to pay for the cost of this Contract
not to exceed a sum of One Hundred Twenty -Four Thousand Nine Hundred Sixty
($124,960.00) Dollars. Payment is contingent upon a final County inspection and
acceptance of work or services.
4. Extra Work. County and Contractor shall negotiate and agree upon
the value of any extra work or services prior to the issuance of a County Change Order
or Renewal/Amendment (CRA) form covering said extra work or services. Such Change
Order or CRA shall set forth the corresponding adjustment, if any, to the Contract Price
and Contract Time.
5. Indemnity. Contractor shall indemnify and hold County, its officers,
officials, agents, and employees, harmless against any and all claims, demands, causes
of action, or other liability, including attorney fees, for any property damages, personal

injuries or death arising out of, relating to, or resulting from the negligence, willful act, or
omission of Contractor, its agents, employees and subcontractors in the performance of
work or services.
6. Insurance. Before commencing any work or services, Contractor
shall procure insurance in Contractor's name and maintain all insurance policies for the
duration of the Contract of the types and in the amounts listed in this Contract. The
insurance shall provide coverage against claims for injuries to persons or damages to
property which may arise from operations or in connection with the performance of the
work hereunder by Contractor, its agents, representatives, employees, or subcontractors,
whether such operations by itself or anyone directly or indirectly employed by it.
7. Minimum Scope and Limits of Insurance
7.1. Commercial General Liability
7.1.1. Contractor shall maintain Commercial General Liability
(CGL) and if necessary, Commercial Umbrella Liability (CUL) insurance with a total limit
of not less than $1,000,000 for each occurrence for bodily injury and property damage.
If such CGL insurance contains a general aggregate limit, it shall apply separately to this
work or services, or the general aggregate shall be twice the required limit.
7.1.2. CGL insurance shall be written on Insurance Services
Office (ISO) "occurrence" form CG 00 01 covering CGL or its equivalent and shall cover
the liability arising from premises, operations, independent contractors, products -
completed operations, personal and advertising injury, and liability assumed under an
insured contract, including the tort liability of another assumed in a business contract.
7.1.3. County, its officers, officials, agents, and employees
are to be covered as additional insureds under the CGL by endorsement CG 20 26 or
an endorsement providing equivalent coverage as respects to liability arising out of
activities performed by or on behalf of Contractor; products and completed operations of
Contractor; premises owned, leased or used by Contractor; and under the CUL, if any.
The coverage shall contain no special limitations on the scope of protection afforded to
County, its officers, officials, agents, and employees.

7.1.4. Contractor's CGL insurance shall be primary as
respects County, its officers, officials, agents, and employees. Any other insurance or
self-insurance maintained by County, its officers, officials, agents, and employees shall
be in excess of and shall not contribute to Contractor's insurance.
7.2. Workers' Compensation and Employer's Liability
7.2.1. Contractor shall maintain Workers' Compensation as
required by the general statutes of the State of North Carolina and Employer's Liability
Insurance.
7.2.2. Employer's Liability, and if necessary, CUL insurance
shall not be less than $1,000,000 for each accident for bodily injury by accident,
$1,000,000 for each employee for bodily injury by disease, and $1,000,000 policy limit.
7.2.3. The insurer shall agree to waive all rights of subrogation
against County, its officers, officials, agents, and employees for losses arising from work
or services performed by Contractor for County.
7.3. Business Auto Liability
7.3.1. Contractor shall maintain applicable Business or
Personal Auto Liability and, if necessary, CUL insurance with a limit of not less than
$1,000,000 each accident. Personal auto insurance may be accepted in lieu of Business
Auto Insurance.
7.3.2. Such insurance shall cover liability arising out of any
auto, including owned, hired, and non -owned autos used in the performance of work or
services.
7.3.3. Business Auto coverage shall be written on ISO form
CA 00 01, or a substitute form providing equivalent liability coverage. If necessary, the
policy shall be endorsed to provide Contractual liability coverage equivalent to that
provided in ISO form CA 00 01.
7.3.4. Contractor's Business Auto Liability insurance shall be
primary as respects County, its officers, officials, agents, and employees. Any other
insurance or self-insurance maintained by County, its officers, officials, agents, and
employees shall be in excess of and shall not contribute to Contractor's insurance.

7.4. Property In Transit Cargo. Contractor shall maintain Property
in Transit and Bailee's coverage in the amount of no less than $1,000,000 for the term of
the contract. This is to cover any and all County property while in transit or in possession of contractor.
7.5. Deductibles and Self -Insured Retentions
7.5.1. Any deductibles or self -insured retentions must be
declared to and approved by County. At the option of County, either the insurer shall
reduce or eliminate such deductibles or self -insured retentions as respects County, its
officers, officials, agents, or employees; Contractor shall procure a bond guaranteeing
payment of deductibles or self -insured retentions.
7.5.2. Contractor shall be solely responsible for the payment
of all deductibles to which all policies are subject, regardless of whether County is an
insured under the policy.
7.6. Miscellaneous Insurance Provisions.
7.6.1. Any failure to comply with reporting provisions of the
policies listed in this Contract shall not affect coverage provided to County, its officers,
officials, agents, and employees.
7.6.2. Each insurance policy required by this Contract shall
be endorsed to state that coverage shall not be canceled by either party except after thirty
(30) days prior written notice has been given to County, 230 Government Center Drive,
Ste. #125, Wilmington, NC 28403.
7.6.3. if Contractor's liability policies do not contain the
standard ISO separation of insureds provision, or a substantially similar clause, they shall
be endorsed to provide cross -liability coverage.
7.7. Acceptability of Insurers. Insurance is to be placed with
insurers licensed to do business in the State of North Carolina with an A.M. Best's rating
of no less than A VI unless County has granted a specific exemption.
7.8. Evidence of Insurance
7.8.1. Contractor shall furnish County with a certificate(s) of
insurance, executed by a duly authorized representative of each insurer, showing
compliance with the insurance requirements prior to commencing the work or services,

and thereafter upon renewal or replacement of each certified coverage until all operations
under this Contract are deemed complete.
7.8.2. Evidence of additional insured status shall be noted on
the certificate of insurance as per requirements in this Contract.
7.8.3. With respect to insurance maintained after final
payment in compliance with requirements, an additional certificate(s) evidencing such
coverage shall be provided to County with final application for payment and thereafter
upon renewal or replacement of such insurance until the expiration of the period for which
such insurance must be maintained.
7.9. Subcontractors. Contractor shall include all subcontractors as
insureds under its policies or shall furnish separate certificates for each subcontractor. All
coverage for subcontractors shall be subject to all of the requirements stated herein. CGL
coverage shall include independent contractors' coverage, and Contractor shall be
responsible for assuring that all subcontractors are properly insured.
7.10. Conditions
7.10.1. County may, at its discretion and with approval of Risk
Management and the Finance Department, accept letters of credit or custodial accounts
in lieu of specific insurance requirements.
7.10.2. Contractor shall warrant the insurance contributing to
the satisfaction of insurance requirements in this Contract shall not be canceled,
terminated, or modified by Contractor without prior written approval of County.
7.10.3. Contractor shall promptly notify New Hanover County
Register of Deeds and New Hanover County Risk Management at (910) 798-7497 of any
accidents arising in the course of operations under the Contract causing bodily injury or
property damage.
7.10.4. County reserves the right to obtain complete, certified
copies of all required insurance policies.
7.10.5. Failure of County to demand a certificate of insurance
or other evidence of full compliance with these insurance requirements or failure of
County to identify a deficiency from evidence that is provided shall not be construed as
a waiver of Contractor's obligation to maintain such insurance.

7.10.6. County does not represent that coverage and limits
will be adequate to protect Contractor and such coverage and limits shall not be deemed
as a limitation of Contractor's liability under the indemnities granted to County in this - -
Contract.
7.10.7.`If Contractor fails to maintain the insurance as set forth
herein, County shall have the right to purchase said insurance at Contractor's expense.
Contractor agrees to reimburse County for all expenses incurred for such purchase.
7.10.8. Contractor or its agent may apply to County for
approval of higher deductibles based on financial capacity and quality of the carrier

affording coverage.
7.10.9. County shall have the right to prohibit Contractor or
any subcontractor from performing work or services and may withhold payment until
required certificates has been received and approved by County.
8. Independent Contractor. The parties mutually agree that the
Contractor is an independent contractor and not an agent of the County, and as such, the
Contractor shall not be entitled to any County employment benefits, such as, but not
limited to, vacation, sick leave, insurance, workmen's compensation, or pension and
retirement benefits.
9. Default and Termination. If Contractor fails to prosecute the work or
services with such diligence as will insure its completion within the Contract time, or if
Contractor breaches any of the terms or conditions contained in this Contract and fails to
cure said breach within two (2) days of County's mailing of Notice of Default, or otherwise
fails to perform the work or services hereunder to the County's reasonable satisfaction,
County may terminate this Contract forthwith. Upon termination, County may, without
prejudice to an action for damages or any other remedy, take the prosecution of the work
or services out of the hands of Contractor. County may enter into another Contract for the
completion of the Contract or use such other methods as may be required for the
completion of the Contract. County may deduct all costs of completing the Contract from
any monies due or which may become due to Contractor. In the event this Contract is
terminated prior to completion of the services by the Contractor, the Contractor shall be
paid for work or services performed to the date of termination. In no event will the amount

due Contractor in the event of termination exceed that amount set forth in this Contract.
Nothing contained herein shall prevent the County from pursuing any other remedy, which
it may have against Contractor, including claims for damages.
10. Termination for Convenience. County may terminate this Contract
for convenience at any time and without cause. Upon receipt of notice, Contractor shall
immediately discontinue providing the work or service and, if applicable, the placing any
orders for any materials, facilities, and supplies in connection with the performance of the
work or services of this Contract.
11. Non -appropriation. All funds for payment by County under this
Contract are subject to the availability of an annual appropriation of the New Hanover
County Board of Commissioners for the services provided under the Contract, County will
terminate the Contract, without termination charge or liability, on the last day of the then -
current fiscal year or when the appropriation made for then -current year for the
services/items covered by this Contract is spent, whichever occurs first. If at any time
funds are not appropriated for the continuance of this Contract, cancellation shall be
accepted by the Contractor on ten (10) business days' prior written notice, but failure to
give such notice shall be of no effect and County shall not be obligated under this Contract
beyond the date of termination.
12. Non -waiver of Rights. The parties mutually agree that either party's
failure to insist upon the strict performance of any provision of this Contract or to exercise
any right based upon a breach thereof, or the acceptance of any performance during such
breach, shall not constitute a waiver of any rights under this Contract.
13. Conflict of Interest. No paid employee of the County shall have a
personal or financial interest, direct or indirect, as a contracting party or otherwise, in the
performance of this Contract.
14. Subcontracts. The Contractor shall utilize no subcontractors for
performing the work or services to be performed under this Contract without the prior
written approval of the County.
15. Entire Contract. This Contract constitutes the entire understanding
of the parties.

16. Binding Effect. This Contract shall be binding upon the parties
hereto, and their heirs, successors, executors, administrators, and assigns.
17. Severabilit . if any provision of this Contract is held unenforceable,
all remaining provisions of this Contract shall remain in full force and effect.
18. Inclusive Terms. Use of the masculine herein shall include the
feminine and neuter, and the singular shall include the plural.
19. Governing Law. All of the terms and conditions contained herein shall
be interpreted in accordance with the laws of the State of North Carolina.
20. E-VerifyCompliance, Pursuant to N.C.G.S. 143-133.3, Contractor
shall fully comply with the U.S. Department of Homeland Security employee "legal status
E-Verify requirements for itself and all its subcontractors. Violation of the provision, unless
timely cured, shall constitute a breach of Contract.
21. Compliance with Federal Law. If applicable, all federally funded
projects, loans, grants, and sub grants whether funded in part or wholly, must be procured
in a manner that conforms with all applicable Federal laws, policies, and standards,
including those under the Uniform Guidance (2 C.F.R. Part 200).
23. Notices. All notices required hereunder to be sent to either party shall

Dear Ms. Piver,
Please find enclosed the results of my recent survey of your records with reference to conservation
treatment of your permanent records.
Our recommendations for the conservation of your records include deacidification, adhesive removal
and reinforcement of paper as necessary (with repair or replacement of index tabs where indicated)
resewing, rebinding or archival grade polyester encapsulation, as appropriate. The deacidification
process, which halts the inevitable self-destruction of acidic paper, should be considered whenever
conservation or even long term storage of unique records is evaluated.
Kofile Preservation has specialized in the deacidification (chemical treatment) and repair of public
records since 1974. During this time we have performed conservation services for over 3000 municipal
and county records management facilities.
Deacidification will be performed after careful testing of paper and inks. Aqueous or non -aqueous
deacidification methods will be determined by the conservation lab professionals. All pressure sensitive
adhesive materials are removed. Mending is done using Japanese tissue and reversible adhesives. Books
are resewn with linen thread and bound in leather or other cover material of choice using acid -free
materials and easily reversible adhesives. Where appropriate, archival grade polyester envelope
encapsulation with placement of materials into custom post binders replaces rebinding.

GENERAL OVERVIEW:
Condition: The majority of the collection is in fair to poor condition and consists of mainley oversized
documents. The paper tested acidic and many leaves are brittle, chipped, crack or torn. Paper is will
require stabilization and mending and flattening. Loose sheets are creased and doggearred.The Index
pages are dirty and worn.
Treatment: Documents to be cataloged and assessed for condition upon receipt. Surface cleaning of
all sheets. Pressure sensitive tape and previous mends to be removed to the extent possible without
causing damage to paper and inks. Paper deacidified using magnesium oxide. All major chips and
tears to be mended with Japanese tissue and flattened when appropriate. After conservation treatment
the documents will be placed into custom made, sheet size specific envelopes of archival grade
polyester with infrared welded seams, (three sided seal). Envelopes to be placed into new custom
made recorder binders with locking bar mechanisms to match existing binders in the New Hanover
Register of Deeds office.
DETAILED SPECIFICATIONS:
(PRV) Preservation —Conservation Treatments, Deacidify, Encapsulate, & Bind
m Kofile creates a permanent log (noting condition, page order, characteristics, and treatments)
for each item upon receipt. Items are inspected and control numbered as necessary. A final
quality check references this log.
• Dismantle volumes by hand (if applicable).
■ Surface clean sheets. Tools include a microspatula, soft dusting brush, latex sponge, powdered
vinyl eraser, or soft block eraser. Surface cleaning removes materials and deposits--e.g., dust,
soot, airborne particulate, sediment from water damage, mold/mildew residue, active micro -
organic growth, insect detritus, or biological ormineral contaminants.
■ Remove any non -archival repairs, adhesives, residual glues, or fasteners to the extent possible
without causing damage to paper and inks.
■ Mend tears and guard burns on back side of sheets with acid free and reversible mending
materials. Sheets aremended with either Japanese tissue and methyl cellulose adhesive or
Filmoplast R® (an acrylic -based, heat settissue). Japanese paper used is often Kozo paper, in
both natural and white finish because of its strength and transparent nature after application.
■ Deacidify sheets (each side of each sheet) after careful testing with Bookkeepers®. This
commercial solution of magnesium oxide, which neutralizes acidic inks and paper by providing

an allcaline reserve (after pH andcompatibility testing). Random testing ensures an 8.5 pH with a
deviation of no more than ± .5.
® Encapsulate each sheet in a Lay Flat Archival Polyester Pocket. Each custom envelope is
composed of Skyroll SH72SO Mylar and includes a patented lay flat design. Dimensions match
s Re -bind in custom -fitted and stamped archival quality binder (a Kofile Recorder binder). Each
binder is manufactured on a per -book basis and sized to 1/4" incremental capacities. This binder is
available with four hubs, a gold -tooled spine, and is roller shelf -compatible. A book may be
returned split into two volumes due to the added weight of the Mylar, depending on page count.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
LEGISLATIVE PRIORITIES RESOLUTION
WHEREAS, several legislative priorities have been identified by the board that are important to the citizens
of New Hanover County; and
WHEREAS, the board will advance these legislative priorities through dialogue and, as appropriate, at the
annual legislative conferences of the N.C. Association of County Commissioners (NCACC) and National
Association of Counties (NACo); and
WHEREAS, none of the legislative priorities are in conflict with NCACC or NACo priorities; and
WHEREAS, the board supports the state identifying a recurring source of funding of at least $25 million
annually to the beach nourishment fund created by the General Assembly in 2018 to support ongoing
coastal storm damage reduction (CSDR) projects. New Hanover County and other coastal communities
can best plan and prioritize local budget needs with dedicated, annual allocations of state support those
communities can use for planning, current projects, or future projects. The board further finds that
protecting coastal infrastructure provides a benefit to the entire state of North Carolina, as public or
private interests from nearly every North Carolina county own coastal property. The board further
supports continued federal and state funding of congressionally approved CSDR projects for Wrightsville
Beach, Carolina Beach, and Kure Beach; and
WHEREAS, the board supports the commitment of necessary federal and state resources to fund the
replacement of the Cape Fear Memorial Bridge. The bridge was built in 1969 and its age and ongoing
maintenance expenses are inadequate to meet future growth; and
WHEREAS, the board supports the state and federal governments establishing formal standards for
perfluorinated chemicals (PFOA and PFOS) and establishing and enforcing health advisory standards for
emerging contaminants to ensure drinking water quality. The board further supports legislation or action
to hold polluters financially responsible for cleanup and remediation of these chemicals in drinking water
and supports a state appropriation to complete the Lower Cape Fear Water and Sewer Authority raw
water transmission line; and
WHEREAS, the board supports administrative and legislative changes to federal agencies and regulations,
including but not limited to, the Federal Emergency Management Agency (FEMA) and the U.S. Housing
and Urban Development Administration (HUD), that would accelerate the flow of aid to local governments
to respond to natural disasters and other emergencies. The board finds that timely disbursement of
federal aid would accelerate the recovery process, provide rapid stabilization, and bolster future
resiliency; and
WHEREAS, the board supports recurring and increased funding for the state's film grant program to
continue attracting film projects that move rapidly and consider numerous locations for productions. The
film industry supports nearly 1,000 local jobs and is a significant contributor to the county's economy. The
board further encourages legislative efforts and opportunities to improve or expand the program; and
WHEREAS, the board supports a statewide school capital commitment of no less than $2 billion at the
earliest possible time in accordance with state statutes. New Hanover County and its school system have

identified more than $400 million of school construction and maintenance needs over the next several
years. The taxpayers of the county are best served if the state authorizes a statewide school capital
commitment with a fair share allocated to New Hanover County schools to aid in its real and pronounced
school construction needs; and
WHEREAS, the board supports the state returning to the original Education Lottery formula that set aside
40 percent for capital needs. The state currently caps the amount of lottery funds that go toward the
Public School Building Capital Fund at $100 million annually. Returning to the originally conceived formula
would net almost $400 million for critical school infrastructure needs; and
WHEREAS, the board supports a federally supported expansion of Medicaid to insure those not eligible
for subsidies through the federal healthcare exchange. As many as 16,000 uninsured New Hanover County
residents could receive health coverage through Medicaid expansion. The board finds that Medicaid
expansion would lead to fair, equitable and cost-effective health care services for those whose employers
do not provide health insurance; and
WHEREAS, the board supports increased federal and state funding to address mental health and
substance use disorder support and treatment; and
WHEREAS, the board supports the state reinstating its financial support for drug treatment courts. The
county has operated a drug treatment court successfully since the state withdrew funding for treatment
courts in 2011 by fully funding, at an expense of more than $1.5 million since 2011, and staffing a drug
treatment and DWI court for county residents. Treatment courts are an extension of the judicial system,
and the state has the primary duty to fund the court system and its associated services; and
WHEREAS, the board supports fair and equitable funding through the N.C. Department of Transportation
for infrastructure to support New Hanover County's transportation needs as the county continues to
rapidly grow. The board finds that appropriate DOT support and developing additional and alternative
revenue sources beyond fuel taxes, will help provide the necessary infrastructure to accommodate an
increasing population and address the board's priorities to encourage an increased stock of affordable
and workplace housing.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners considers
these, among others, as important priorities for representatives at the state and federal level to address
in 2023 and 2024.

BRIEF SUMMARY:
Coastal Protection Engineering of North Carolina, Inc. (CPE-NC) began monitoring seven tidal creeks within New
Hanover County on a monthly basis in November 2007. The creeks included in this study are Pages, Futch, Lords, Mott,
Barnards, Smith, and Prince George. Beginning this program year, the mainly undeveloped watershed of Island Creek in
northern New Hanover County was added to gain a baseline assessment of the watershed prior to future
development. I n addition, three sampling sites from within the freshwater pond at Airlie Gardens are monitored.
Physical and biological parameter data is collected at each of the tidal creek sampling locations. Physical parameters
include temperature, salinity, conductivity, pH, turbidity, and dissolved oxygen. Biological parameters include
chlorophyll -a and Enterococci. At Airlie Gardens, physical parameters as well as chemical parameters including
orthophosphate and nitrate/nitrite are monitored, Enterococci samples are not collected at Airlie Gardens.
The information included in the annual report focuses on the results of the monitoring period that took place from J my
2021 through June 2022. Long term trends have also been assessed using data obtained since 2007. The purpose of
this presentation is for CPE-NC staff to present data from the FY 2021-2022 monitoring program and long term trends.
In general, the dissolved oxygen levels within each creek have not changed notably from year to year and continue to
be non -problematic, though dissolved oxygen levels within Prince George Creek have been consistently low, which may
be attributed to the natural slow moving water of the creek. Turbidity has slightly increased in several creeks since
2008 but overall, turbidity levels remain non -problematic. Levels of chlorophyll -a in all watersheds have remained
consistent and show no signs for concern.
Overall, Enterococci bacteria levels during the 2021-2022 sampling for the majority of the watersheds remained the
same with the exception at Mott Creek, where levels have improved. Enterococci bacteria has had a history of
elevated levels that have been of carefully monitored in Mott, Pages, Barnards, Smith, and Prince George creeks. Lords
Creek and Futch Creek, on average, have contained relatively lower bacteria levels compared to the other creeks.
As an ongoing effort to identify the source of bacteria in the Pages Creek watershed, this program year staff has
worked with CPE to perform additional water quality testing, which indicated there were Enterococci bacteria in the
water coming from groundwater seeps flowing from the creek bank adjacent to two water quality monitoring sites
(BDUS, BDDS). These seep areas were identified from the thermal imagery study conducted last year. Additional
samples from those seeps were sent to a laboratory to test for a human signature which suggested that while the
samples contained bacteria, they did not have any or enough of the human marker tested to result in a quantifiable
significant amount. At this time, the Cape Fear Public Utility Authority is currently visually inspecting their
infrastructure in the Bayshore community using closed circuit television to identify any deficiencies in the

EXECUTIVE SUMMARY
This report represents the findings of the New Hanover County Water Quality Monitoring Program for the
period July 2021 to June 2022. The results and long-term trends presented in this report are described
from a watershed perspective. Since 2007 the county has partnered with Coastal Protection Engineering
of North Carolina to test water quality at nineteen monitoring stations within seven tidal creeks in New
Hanover County. The creeks monitored include Barnards, Futch, Lords, Mott, Pages, Prince George, Smith,
and Island. This monitoring period (2021-2022) included the addition of one station at Island Creek to
capture baseline data since future development is expected within the watershed. Each creek is
monitored monthly for physical, chemical, and biological parameters that indicate overall water quality.
The objective is to evaluate the current parameters at each creek to determine the impact (if any) of the
built environment on water quality. In addition to the raw sampling results, a general assessment of the
water quality is provided for each watershed. The general assessment gives each parameter the rating of
either "Good", "Fair", or "Poor" depending on the percentage of samples that went above the State
standard for turbidity, chlorophyll -a, and Enterococci, or below the State standard for dissolved oxygen.
If the recorded value of a parameter went outside the acceptable range of the State standard less than
10% of the times sampled the watershed will receive a "Good" rating, a "Fair" rating 11%-25% of the times
sampled, or a "Poor" rating for greater than 25% of the sampling times.

Long Term Trends
Dissolved oxygen, turbidity, and chlorophyll -a levels fluctuate on a seasonal basis where, typically, levels
decrease in the winter and increase in the summer. In general, turbidity and chlorophyll -a levels over
time have not been of concern. Likewise, dissolved oxygen levels have not changed drastically from year
to year and there have been minimal issues with low dissolved oxygen levels except for Prince George
Creek where levels have been consistently low over time. This is due to its naturally slow water flow,
which is more characteristic of swamp -like waters. Slower moving waters typically have lower dissolved
oxygen levels.
Overall, Enterococci bacteria levels during the 2021-2022 sampling for the majority of the watersheds
remained the same with the exception Mott Creek which saw an improvement. There is a history of
elevated levels of Enterococci bacteria that have been of carefully monitored over the years within Mott,
Pages, Barnards, Smith, and Prince George creeks. Lords Creek and Futch Creek, on average, have
contained relatively lower bacteria levels compared to the other creeks.

It should be noted that monitoring at Island Creek began this year, hence, long-term trends are not
available and have not been included in this report.
In addition to monitoring the tidal creeks, in 2015 New Hanover County began monthly testing at the lake
at Airlie Gardens due to concerns of water quality and noticeable algal blooms that had occurred over the
years. The lake drains directly into Bradley Creek, close to the Intracoastal Waterway. There are three
sampling sites located where contributing water enters the lake (intake), in the middle of the lake, and at
the outfall before the water enters Bradley Creek.
Since 2015, water quality monitoring has shown that dissolved oxygen varies significantly over an annual
basis, increasing during the warmer summer months and decreasing during the colder winter months.
Overall, there are no current concerns with the dissolved oxygen levels.
Over the past seven years, the levels of the nutrient Nitrite/Nitrate have generally been higher at the
intake compared to the sampling sites located at the middle and at the outfall of the lake. This
orthophosphate trend was observed during the first three years of monitoring, however, over the past
two years this trend has reversed, where orthophosphate was lower at the intake and higher in the middle
and the outfall of the lake. High concentrations of orthophosphate and Nitrite/Nitrate have been linked
to algae growth leading to algal blooms which can cause low dissolved oxygen and a decline in overall
water quality. Since monitoring began, it has been observed that levels of orthophosphate have
incrementally increased each year. Nitrate/Nitrite levels have also increased over time, however not in
the same linear fashion as orthophosphate.
Chlorophyll -a levels are also indicative of the presence of algal blooms. In recent years levels have
increased at the middle and outfall of the lake compared to the sampling location in proximity to the
intake into the lake. In general, Chlorophyll -a levels have steadily increased within the lake over time
since sampling began in 2015.
Improvement Efforts
While urbanization and development can be factors that can impact water quality, the ratings for many
water quality parameters as depicted in this report have improved or remained steady over the past
several years. This suggests that even though the unincorporated portions of New Hanover County
continue to build out, there are factors minimizing the impact to water quality. While these factors
facilitating this trend have not been identified, several notable efforts maybe contributing to these
improvements.
Efforts made by New Hanover County over the years to improve water quality include property acquisition
using grant and trust fund sources, working with the Cape Fear Public Utility Authority (CFPUA) to test
sewer infrastructure, the installation of stormwater Best Management Practices (BMPs) such as
raingardens, infiltration basins, and impervious surface retrofits, and bacteria source tracking. In 2008,
New Hanover County partnered with University of North Carolina Wilmington's Center for Marine Science
and Coastal Protection Engineering of North Carolina, Inc. to conduct DNA source tracking which led to
the identification of a human source for the bacteria in Pages Creek. This suggested that the source of
the bacteria in the creek was from nearby wastewater infrastructure such as septic tanks systems and/or
the municipal sewer system. Following the report, the New Hanover County Planning & Land Use
department partnered with the Cape Fear Public Utility Authority and the New Hanover County Health
department to search for leaking septic or sewer, however, that investigation did not find the source of

contamination. In 2013 the county partnered with the University of North Carolina Chapel Hill to expand
the source tracking and conducted a study on the enterococci bacteria in Mott and Smith creeks and again
at Pages Creek. That study found the presence of a human signature in the bacteria for all three creeks.
In an attempt to identify any possible sources of bacteria entering Pages Creek, in 2019 New Hanover
County partnered with the University of North Carolina Wilmington's (UNCW) Socio-Environmental
Analysis Laboratory and Coastal Protection Engineering (CPE) of North Carolina to conduct a thermal
imagery scan of two portions of the creek adjacent to monitoring sites that have consistently detected
elevated levels of Enterococci bacteria. Following the flight, UNCW and CPE analyzed the imagery and two
areas that showed uncommon differences in temperature variation were identified.
Ground truthing these areas revealed several subterranean groundwater seeps entering the creek from
the streambank in the vicinity of sewer lift stations. In June and July of 2022 planning staff, CPE, and the
Cape Fear Public Utility Authority coordinated to perform additional testing of the seep water coming
from the creek bank in these two locations that identified Enterococci bacteria in the water. Additional
laboratory analysis was conducted of samples collected from the seeps which resulted in the non -
detection of a human marker at the Pages Creek down -steam site (PC-BDDS) and unquantifiable from the
up -stream site (PC-BDUS). The results from the additional testing and indicator analysis can be found in
Appendix D of this report.
At Airlie Gardens, to help combat problems associated with eutrophication and overall water quality the
Park and Gardens department has implemented initiatives identified in their stormwater master plan.
These initiatives include installing several aerators in the lake to increase the dissolved oxygen levels,
restore a wetland area near the entry point where water enters the lake and the completion of a dredging
operation effectively removing approximately 4,000 cubic yards of bottom sediment and material. The
county continues to monitor the lake as it may take several years for a data trend to emerge. Data from
this past year has not shown a reduction in nutrient loading into the lake.

INTRODUCTION
New Hanover County's (NHC) location is unique since with the exception of the northeastern boundary,
it is surrounded by water on three sides; on the north and south by the Northeast Cape Fear River, on the
west by the Cape Fear River, and on the east by the Atlantic Ocean. It is primarily a coastal county
containing many creeks, streams, and water bodies that provide the opportunities for a wide range of
recreational activities for thousands of local citizens and visiting tourists yearly. Due to its proximity to
the Atlantic Ocean and the Intracoastal Waterway, NHC's tidal creeks are not only used for recreation but
are an important resource for the natural environment as they provide habitats for various plant and
animal species. Tidal creeks are rich areas in terms of aquatic, terrestrial, and avian wildlife and can
support complex food webs (Odum et al., 1984; Kwak and Zedle,1997). Therefore, protection of the water
quality within these creeks is a high priority for the county.
Water quality has been monitored in New Hanover County since the early 1970s by the State in efforts to
study the impacts of adjacent septic systems on water quality in tidal creeks. An increase in the closure of
tidal creeks for shellfishing became an early concern for the citizens of New Hanover County and was a
topic included in early land use plans. The ongoing water quality conversation within the community led
to several watershed plans and in 1993, New Hanover County and the City of Wilmington partnered with
the University of North Carolina Wilmington (UNCW) to conduct a long-standing water quality monitoring
program.
However, in November 2007, Coastal Protection Engineering of North Carolina, Inc. (CPE) began a
separate, monthly water quality monitoring program on behalf of New Hanover County for the tidal creeks
within the unincorporated parts of the County.
The information presented in this report focuses on the results of this monitoring from July 2021 to June
2022. The creeks included in this study are Pages and Futch, which drain into the Atlantic Intracoastal
Waterway (ICW), Island Creek, which drains into the Northeast Cape Fear River and Lords, Mott, Barnards,
Smith, and Prince George, which drain into the Cape Fear River (Figure 1). In addition to the continued
sampling from the seven tidal creeks, three sampling sites from within Airlie Gardens have been
monitored since 2015.
The results described in this report represent the physical, biological, and chemical data collected monthly
from all sampling sites from July 2021 through June 2022. These results are organized by watershed
alphabetically, with the results of the eight tidal creeks presented first, followed by the results from Airlie
Gardens. Additional creek data, including parameters not summarized in this section, from the tidal creeks
sampling sites and the Airlie Garden sampling sites can be found in Appendix A.
Based on the raw data, a quantitative system assigns a rating of "Good", "Fair", or "Poor" to a sampling
station depending on the percentage of samples that went above the State standard for turbidity,
chlorophyll -a, Enterococci, or below the State standard for dissolved oxygen. If the recorded value of a
parameter went outside the acceptable range of the State standard less than 10% of the times sampled
the station will receive a "Good" rating, a "Fair" rating 11%-25% of the times sampled, or a "Poor" rating
for greater than 25% of the sampling times. This general description is useful when looking at trends from

Public Hearing and Consideration of Approval to Amend the March 5, 2021 Development Agreement with Cape
Fear FD Stonewater to Include Construction of a New Board of Elections Building and Adoption of Associated
Budget Amendment
BRIEF SUMMARY:
Under a development agreement dated March 5, 2021 ("the Original Agreement"), the county has previously
contracted with Cape Fear FD Stonewater ("Cape Fear") for the construction of the new Government Center building,
which is now nearly complete. The new Government Center building is located at the same site as the existing
Government Center building.
One of the uses of the new Government Center building was to be the home for the county's Board of Elections,
which was temporarily relocated from the Government Center location to the Northeast Library during the
construction of the new Government Center building.
As the final design and operational considerations of the new Government Center were finalized, staff concluded that
the new building was not optimal for the specialized needs of the Board of Elections, which would have resulted in
inefficiencies and inconveniences for both election officials and the voting public, including an inconvenient process for
curbside voting. For many of those same reasons, staff also concluded that the current space being occupied in the
Northeast Library was not a satisfactory permanent location.
Accordingly, it was determined that the county would be best served by the construction of a stand-alone, purpose-
built facility on excess land located at the new Government Center site. The proposed design of the dedicated building
consists of approximately 7,500 square feet and includes a lobby, conference room, offices, workstations, hoteling
space, a mail -in ballot room, secure storage and a large one -stop voting space. I n addition, the exterior includes a large
canopy to provide protection from the elements for the curbside voting process.
The proposed amendment to the Original Agreement to include this new building includes an upward adjustment to the
guaranteed maximum price of $5,594,881, which includes $236,404 in additional development fees, and contemplates
that the same pro rata share of cost savings if the project is completed under -budget, with the county being entitled to
80% of the savings and 10% each for Cape Fear and the general contractor. If approved, construction is expected to
begin in three to four months. A public notice describing this amendment and providing notice of the public hearing
was published in the Star News on December 23, 2022.
The $5,594,881 increase in cost was included in the county's 2022-2023 adopted budget as a capital improvement plan
item and is expected to be financed with long-term debt. A budget amendment is also proposed to transfer this project
amount from the Capital Improvement Projects Capital Project fund to the Government Center Redevelopment

AMENDMENT TO DEVELOPMENT AGREEMENT
THIS AMENDMENT TO DEVELOPMENT AGREEMENT ("Amendment") is made
this day of , 2023 by and between the COUNTY OF NEW HANOVER,
a public body, corporate and politic (the "County") and CAPE FEAR FD STONEWATER,
LLC, a North Carolina limited liability company and its successors and assigns (the
"Developer")
WITNESSETH:
WHEREAS, the County and Developer entered into that certain Amended and Restated
Development Agreement dated March 5, 2021 (the 'Development Agreement") (collectively,
the Development Agreement and this Amendment are hereinafter referred to as the
("Agreement") regarding the development of certain land located at 230 Government Center
Drive, Wilmington, North Carolina and as more particularly described on Exhibit A to said
Development Agreement ("Property");
WHEREAS, capitalized terms not defined in this Amendment shall have the same
meaning as those terms defined in the Development Agreement;
WHEREAS, where any terms of the Development Agreement and this Amendment
conflict, this Amendment shall control;
WHEREAS, the Development Agreement contemplated that the parties intended to
develop "Parcel V of the Property as a new Government Center Complex, including an
Emergency Operations and 911 Center for the County, as generally depicted on Exhibit B to the
Development Agreement;
WHEREAS, the Development Agreement also contemplated that the Developer would
purchase "Parcel 2" of the Property from the County and develop a mixed use development on
the same;
WHEREAS, the parties wish to amend the Development Agreement to include
development of a Board of Elections facility on Parcel 1, which is to be developed consistent
with the presentation, plans, and specifications attached to this Amendment as Exhibit C-1
("Board of Elections Facility");
WHEREAS, the consideration to be paid by County to Developer for assistance with
facilitating the entitlement approval, design, and construction of the Board of Elections Facility
as part of the Government Center Improvements, as the same have been amended by this
Amendment, has been found to be reasonable;
WHEREAS, the Project, as the same has been amended by this Amendment, will
promote economic and cultural development of the area, and will enhance the public welfare and
the public use and enjoyment of the area;

WHEREAS, on , 2023, the County Commissioners considered this
Amendment and after a public hearing regarding the same, voted by a vote, to
approve this Amendment; and
WHEREAS, the parties desire to amend the terms of the Development Agreement as set
forth herein.
NOW, THEREFORE, in consideration of the foregoing premises, the Development
Agreement, this Amendment, and the undertakings set forth in the same, the County and
Developer hereby agree as follows:
1. The foregoing recitals are incorporated by reference as if fully stated herein.
2. Board of Elections Facility. The parties agree that the Development Agreement
shall be amended to contemplate expansion of the Government Center Improvements to include
the development of a Board of Elections Facility on Parcel 1, as further detailed below.
a. The term "Government Center Improvements," as used in this Agreement,
is hereby revised to include the Board of Elections Facility, as the same is to be developed
consistent with the presentation, plans, and specifications attached to this Amendment as Exhibit
C1. Exhibit C-1 is hereby incorporated by reference and made a part of this Agreement.
b. The scope of Developer's services is hereby expanded to include
managing the development of the Board of Elections Facility. The Developer shall serve as the
representative of the County in connection with the entitlement approval for the Board of
Elections Facility and the design and construction of the Board of Elections Facility.
C. The Project Budget is hereby increased by Five Million Five Hundred
Ninety -Four Thousand Eight Hundred and Eighty -One Dollars ($5,594,881), to include the costs
associated with the development of the Board of Elections Facility, as shown on Exhibit D-1 to
this Amendment. This Project Budget increase includes an increase of the Development Fee by
Two Hundred Thirty -Six Thousand Four Hundred and Four Dollars ($236,404) in consideration
of the Developer's increased scope of work contemplated under this Amendment. Exhibit D-1 is
hereby incorporated by reference and made a part of this Agreement.
d. The Manager and staff of the County and the Developer agree to amend
the Project Management Agreement in conformity with this Amendment, including but not
limited to incorporating the expansion of the Developer's duties, increasing the Project Budget,
and providing for the additional Development Fee as contemplated herein.
e. The parties shall continue to be entitled to the same proportion of cost
savings contemplated under the Development Agreement where the Actual Construction Cost is
less than the cost contemplated under the GMP Construction Contract. However, this concept in
the Development Agreement shall be adapted in accordance with the increased scope of work
and increased costs contemplated under this Amendment. Accordingly, the "Actual Construction
Cost," as that term is used in the Development Agreement, will be a summary and accounting of

the total actual cost of construction of the work inclusive of that work described on both Exhibit
C and Exhibit D-1 of this Agreement. Similarly, the GMP Construction Contract price shall
include the increased costs for development of the Board of Elections Facility as contemplated
under this Amendment. The Manager and staff of the County and the Developer further agree to
amend the GMP Construction Contract to include the scope of work and costs associated with
the development of the Board of Elections Facility.
3. Contingencies. The parties' obligations hereunder are expressly conditioned on
the following:
a. Approval by the County Commissioners. The parties acknowledge and
agree that this Amendment has been approved by an affirmative vote of the County
Commissioners on , after publication and notice of the Amendment
pursuant to N.C.G.S. § 143-128.1C.
b. Project Management Agreement. This Amendment is contingent upon
execution of an amendment to the Project Management Agreement by the County and the
Developer, consistent with the terms and conditions described herein.
4. Except as amended hereby, the Development Agreement shall remain in full force
and effect and is hereby ratified and reaffirmed. This Amendment may be executed in a number
of identical counterparts, each of which for all purposes is deemed an original.

Update on Street Outreach and Adoption of Amendment to New Hanover County Code of Ordinances Chapter
38
BRIEF SUMMARY:
On September 19, 2022, the New Hanover County Board of Commissioners approved the comprehensive program,
known as Getting Home, to address homelessness within the City of Wilmington. This program has paired social
workers from the New Hanover County Department of Social Services with law enforcement officers from the City of
Wilmington police department.
Although this program is experiencing success, the county is still facing challenges at its property bordered by Third,
Grace, Chestnut, and Second Streets. These challenges include, but are not limited to, alleged criminal activity, littering,
and use of outdoor and parking deck areas as restrooms.
In order to better address these challenges, county staff would like to propose amending Chapter 38 of the New
Hanover County Code of Ordinances. Following is a summary of the amendment:
• Sleeping on county property will be prohibited from 10:00 p.m. to 7:00 a.m.
• Items left unattended are subject to disposal.
• Parking decks and parking lots are for parking and associated activities only.
• Entrances to county facilities and associated areas are for ingress and egress only.
• This ordinance will apply to all county owned and leased properties.
• Parts of this ordinance do not apply to emergency management sheltering events, county employees in the
performance of their job duties, and the general public within a county facility for the purpose of transacting
business.
• Exceptions to this ordinance can be made by the county manager or their designee.
This ordinance will aid the county in keeping its properties safe, properly maintained, and attractive. If adopted,
community outreach will take place to ensure potentially impacted parties are aware of the ordinance so they can
comply before enforcement takes place.
Because this item is the adoption of an ordinance without a public hearing, it is required that the approval be by
unanimous vote in order to forgo a second reading and approval.

ORDINANCE
AMENDING NEW HANOVER COUNTY CODE CHAPTER 38
WHEREAS, the intent of this ordinance, in conjunction with other county efforts through its Health and Human
Services Department, is to provide for the safety and health of all its community members and to aid in keeping its
properties safe, properly maintained, and attractive.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of New Hanover County, hereby
ordains and enacts that New Hanover County Code, Chapter 38, Offenses and Miscellaneous Provisions, Article II,
Offenses Against Property, be amended with the following new ordinances:
Sec. 38-34. — Certain Prohibited Action on County Property.
Unless otherwise expressly authorized by public signage or written permission of the County Manager or
their designee, it shall be unlawful for any person to do any of the following on or within any property owned by or
leased to the County:
(a) Occupy, camp, sleep, or place, erect or utilize any tents, cooking equipment or bedding between the
hours of 10:00 PM and 7:00 AM or such other times as prohibited by signage, rule, policy, regulation,
or law; and
(b) Personal effects, including but not limited to, clothing, food, bedding or eating equipment, shall not be
left unattended; and
(c) County parking deck(s) are for parking and associated activities; therefore, other uses are prohibited;
and
(d) Entrances to county facilities, and associated areas, are for ingress and egress to county facilities;
therefore, other uses are prohibited; and
(e) Surface parking lots are for parking and associated activities; therefore, other activities are prohibited;
and
(f) Subsections (a) and (b) of this section do not apply to emergency management sheltering events and
county employees in the performance of their job duties; and
(g) Subsection (b) of this section does not apply to the general public present within a county facility for
the purpose of transacting business.
Sec. 38-35. — Penalties.
(a) Any person violating Sec. 38-34(a), (c), (d), and/or (e) may be subject to removal by law enforcement
off the premises as a trespasser and be subject to those criminal sanctions set forth in Chapter 14 of
the North Carolina General Statutes; and
(b) For health and safety reasons, any personal effects left unattended pursuant to Sec. 38-34(b) may be
deemed abandoned and forfeited to the County for disposal at its election.
Except as specifically amended above, Chapter 38, Offenses and Miscellaneous Provisions, shall remain unaltered
and in full force and effect.

I direct the Center for Southeast North Carolina Archives and History at UNCW's William Madison Randall Library. I am also the
president of the Society of North Carolina Archivists. I work closely with community members and cultural heritage groups
throughout Southeast North Carolina to preserve and provide access to the sources of regional history and culture. I also teach
Wilmington History courses in the Honors College and History Department at UNCW, as well as in the Osher Lifelong Learning

My professional activities focus heavily on regional history and culture, and I want to see the stories of all citizens of New
Hanover County — past and present — highlighted and honored. My daily work focuses on archival research collections related
to these stories, but I also do a great deal of outreach work to encourage use of these collections. I would like to learn more
about how the Library can work with the community to preserve important historical sources and educate the wider community
on the fascinating history of our diverse home. I would also like to work with likeminded people outside the Library to find ways
to use our common resources to publicize New Hanover County's efforts in preserving and educating about local African
American history.
What areas of concern would you like to see addressed by this committee?
I would like to see what the Commission can do to encourage the preservation of papers, photographs, church records, etc.

NEW HANOVER COUNTY NON -COUNTY AGENCY FUNDING COMMITTEE
Number of Members: 7 members appointed by the County Commissioners as follows:
1 member for each of the following categories: At -Large, Educational (pre-k thru 12), Faith -Based,
Seniors/Elders, Business/Workforce Training, Public Safety/Judicial, and Cultural/Recreation.
Term of Office: 3-years with no one serving more than two (2) full successive terms
Meeting Schedule: As needed between September 1st and March 30th of each fiscal year.

implementation of management objectives, coordinated multi -department projects.
Supervised budget planning and implementation. Lead staff in strategic planning, coalition,
and team building. Worked closely with community -based organizations to ensure that
services were timely, effective, and accessible to all residents.

Performing Arts Director 07/1986 to 07/2007
Created a comprehensive cultural program that included performances by visiting
professional artists in music, theatre, and dance. The Alden also featured a professional
performance series for children, a high school scholarship competition, multiple film series
and lecture series. Directed program development, volunteer training and recruitment,
