The RFP is for Teen Court and Mediation programs. The RFP closes on April 30, 2021. The recommendation meets the JCPC funding priorities of Psychological Assessments, Counseling, Sex Offender Evaluation and Treatment, Community Services and Restitution, Teen Court, Parent /Family Skill Building Program, Interpersonal Skill Building, Home -Based Family Counseling, Substance Abuse Prevention /Education, Mediation, and Vocational Skill Training. Funded Programs Descriptions Attachments: Board of Commissioners - April 19, 2021 ITEM: 2 - 1 - 1 Executive Summary The New Hanover County Juvenile Crime Prevention Council (JCPC), in fulfillment of the duties and responsibilities as set forth in the General Statutes of the State of North Carolina, has reviewed and updated the County Plan. The JCPC has identified the issues and factors which have an influence and impact upon delinquent youth, at -risk youth, and their families in New Hanover County. Further, the JCPC has identified the strategies and services most likely to reduce /prevent delinquent behavior. JCPC Action Plan Pro ress: • To prevent or reduce delinquent behavior in youth • Continue the Community Service /Restitution Program • Continue the Home -Based Family Services Program • Continue the Teen Court Program Priorities for Funding: Through a risk & needs assessment and a resource assessment, the JCPC has determined that the following services are needed to reduce /prevent delinquency in New Hanover County. • Psychological Assessments • Counseling • Sex Offender Evaluation and Treatment • Community Services and Restitution • Teen Court • Parent /Family Skill Building Program • Interpersonal Skill Building • Home -Based Family Counseling • Substance Abuse Prevention /Education • Mediation • Vocational Skill Training Monitoring and Evaluation: Each program funded in the past year by the JCPC has been monitored. The monitoring results and program outcomes evaluations were considered in making funding allocation decisions. The JCPC continues to conduct implementation monitoring of its action plan and its funded programs on a quarterly basis. Funding Recommendations: Having published a Request for Proposals for these needed services for a minimum of thirty (30) days, the JCPC has screened the submitted proposals and has determined which proposals best meet the advertised needed services. As required by statute, the JCPC recommends allocation of the NC Department of Juvenile Justice and Delinquency Prevention (NC DJJDP) Funds to the following Programs in the amounts specified below for the upcoming fiscal year: (See JCPC Funding Allocations page): 1. Risk The Risk and Needs Assessment Committee reviewed data gleaned from the Juvenile Risk Assessment instrument administered by Juvenile Court Counselors after juveniles are referred with a complaint alleging that a delinquent act has occurred and prior to adjudication of the juvenile. The Juvenile Risk Assessment is an instrument used to predict the likelihood of the juvenile being involved in future delinquent behavior. For some youth, some of the individual item ratings may be heavily dependent upon information reported by the juvenile or the parent(s). For these items (represented by percentages which with a star next to them), there is a likelihood of under- reporting the incidence of a particular behavior and the actual incidence may be higher than suggested by these figures. In those cases, the figure should be interpreted as a measure of the minimum level of occurrence. New Hanover Counly Risk Factor Observations: Data from FY 2019 -2020 • 82% of youth have a medium to high risk level for recidivism. • Nearly half (43 %) of adjudicated youth report some involvement with alcohol or drugs and need further assessment or treatment. This is higher than the state rate and is slightly higher than last fiscal year. • 61 % of adjudicated youth have moderate to severe school behavior problems. • More than half of the youth, 61 %, lack positive peer relationships. • 50% of youth referred to juvenile court have had at least one prior referral • 39% of youth have had at least one prior adjudication • Nearly a fourth of families are unwilling or are unable to properly supervise their children. Part II. Needs The Risk and Needs Assessment Committee also reviewed data gleaned from the Juvenile Needs Assessment instrument administered by Juvenile Court Counselors prior to court disposition of a juvenile. The Juvenile Needs Assessment is an instrument used to examine a youth's needs in the various domains of his life: The Individual Domain, The School Domain, The Peer Domain, and the Community Domain. This instrument was designed to detect service intervention needs as an aid in service planning. As with the Juvenile Risk Assessment, some of the individual item ratings may be heavily dependent upon information reported by the juvenile or the parent(s). In those cases, the figure should be interpreted as a measure of the minimum level of occurrence New Hanover County Elevated Needs Observations; Data from FY 2019 -2020 • 97% of youth have a low to medium needs and can be served in the community. • 83% of youth have some level of mental health needs. • 62% of adjudicated youth have difficulty with positive peer relationships, have some association or regularly associate with delinquent peers or have gang association. • 60% of adjudicated youth have moderate or serious school behavior problems • At a minimum, 44% of adjudicated youth have some of substance abuse and/or need substance abuse treatment. • One in four adjudicated youth live in a home with domestic discord or domestic violence. • Nearly half (46 %) of the adjudicated youth come from a family with marginal to inadequate supervision skills. • 2 out of 5 adjudicated youth live in a home with someone who has a criminal history or gang involvement. Summary of Gaps and Barriers in the Continuum of Services Appropriate intermediate dispositional options are available in New Hanover County through the Community Service, Restitution and Teen Court programs, funded through the JCPC. If funding were to be discontinued for these services, a new gap would exist and adequate intermediate dispositional options would not be available. The need for mental health assessment and treatment services continues to exist and to grow. Without the JCPC funded psychological services programs, a larger gap would exist. New programs in the community have helped to fill in the gaps. Part V. Proposed Priority Services for Funding The committee compared the services needed to address the elevated Juvenile Risk Factors and Juvenile Needs with services currently available in the community. Services which are currently available in the community and sufficient to meet the needs of court involved youth or those youth most at risk for court involvement are not considered as a priority for JCPC funding. People are spending more and more of our lives online whether that is for work, school, or entertainment. Unfortunately, with this increase in virtual connection comes an increase in online abuse and harassment. Board of Commissioners - April 19, 2021 ITEM: 5 New Hanover County Contract # 21 -0353 STATE OF NORTH CAROLINA AWARD OF FRANCHISE AGREEMENT FOR COUNTY OF NEW HANOVER SOLID WASTE SERVICES THIS FRANCHISE AGREEMENT made and entered into this the day of 2021, by and between NEW HANOVER COUNTY, North Carolina, a political subdivision of the State of North Carolina, hereinafter called "County" and CAPE FEAR HAULING LLC with its principal mailing address 3602 New Holland Dr., Wilmington, NC 28412, hereinafter called "Operator." WITNESSETH WHEREAS, the County has, through the power granted to it under G.S. 153A -136, adopted an ordinance regulating the collection and disposal of solid wastes and requiring that all waste haulers have a license and a franchise in order to operate in the County, in order to provide the residents and commercial customer of the County with reliable, environmentally sound waste disposal now and in the future; and WHEREAS, Operator has contracted with commercial and /or residential customers located in New Hanover County in order to provide solid waste collection and disposal; and NOW THEREFORE, in consideration of the mutual benefits inuring to the parties hereto, and based upon the mutual covenants contained herein and the considerations stated herein, the parties do hereby covenant and agree, and County hereby conveys a non- exclusive franchise to Operator, to collect and dispose of solid wastes to commercial and /or residential customers in the County. The parties therefore agree to the following terms and conditions: 1. Terms of Agreement. The initial term of this Franchise Agreement shall be seven (7) years from the date of signing. The Franchise may automatically renew and extend for a subsequent seven (7) year term, contingent upon County Commissioners approval pursuant to G.S. 153A -46. 2. Scope of Services. For the term of this Franchise Agreement, Operator agrees to provide commercial and /or residential customers with solid waste collection and transportation to County- approved disposal sites. 3. Disposal at County - Approved Facilities. Operator agrees to dispose of all waste collected in the County, as part of this franchise agreement, at County- approved facilities consistent with State law. With regard to County- approved facilities, said approval must be obtained by Operator prior to the disposal at said facilities, and said approval shall be granted or denied entirely at the discretion of the County. The County also has the authority to designate which facilities shall be used. 4. Administration /Billing. All billing of customers shall remain the responsibility of the franchisee. 5. Franchise. It is understood and agreed that all of the terms and conditions of New Hanover County Code Chapter 44, entitled "Solid Waste," pertaining to a franchise Board of Commissioners - April 19, 2021 ITEM: 5 - 1 - 1 New Hanover County Contract # 21 -0353 for solid waste collections are incorporated herein by reference and made a part hereof as if fully set forth, including but not limited to insurance requirements. 6. Personnel and Equipment. Operator shall equip and maintain all vehicles with staff and equipment to comply with any applicable regulations and laws. 7. Independent Contractor. It is mutually understood and agreed that Operator is an independent contractor and not an agent of the county, and as such, Operator, its agents and employees shall not be entitled to any County employee benefits, and as such, Operator, its agents and employees shall not be entitled to any County employment benefits, such as, but not limited to, vacation, sick leave, insurance, workers' compensation, or pension or retirement benefits. 8. Indemnity. To the extent permitted by law, Operator shall indemnify and hold the County, its agents and employees, harmless against any and all claims, demands, causes of action, or other liability, including attorneys' fees, on account of personal injuries or death or on account of property damages arising out of or relating to the work to be performed by Operator hereunder, resulting from the negligence of or willful act or omission of Operator, its agents, employees and subcontractors. To the extent permitted by law, the County shall indemnify and hold the Operator, its agents and employees, harmless against any and all claims, demands causes of action, or other liability, including attorneys' fees, on account of personal injuries or death or on account of property damages arising out of or related to the solid waste services operated and administered by the County, and resulting from the negligence of or willful act or omission of the County, its agents, employees, and subcontractors. 9. Business Auto Liability. Operator shall maintain applicable Business Liability and, if necessary, Commercial Umbrella Liability insurance with a limit of not less than $1,000,000 each accident. Such insurance shall cover liability arising out of any auto, including owned, hired, and non -owned autos used in the performance of work or services. 10. Assignment, Contracting_ The parties agree that this agreement is not transferable or assignable by either party without the written consent of the other party to this agreement. Operator shall not subcontract with another entity to perform the services described herein without the approval of the County Manager or his designee. 11. Termination. The franchisee may terminate this franchise upon three hundred sixty -five (365) days written notice, or less notice with the consent of the County. The County may only revoke the franchise for cause as set out in Chapter 44, "Solid Waste," of the New Hanover County Code. This franchise may be modified or revoked by the County in the event that an ordinance is passed by the Board of Commissioners creating an exclusive franchise system for residential solid waste collection in the unincorporated County. 12. Non - Waiver of Rights. It is agreed that County's failure to insist upon the strict performance of any provision of this agreement or to exercise any right based upon Board of Commissioners - April 19, 2021 ITEM: 5 - 1 - 2 New Hanover County Contract # 21 -0353 a breach thereof, or the acceptance of any performance during such breach, shall not constitute a waiver of any rights under this agreement. 13. Equal Opportunity. In connection with the performance of this agreement, Operator agrees not to discriminate against any employee or applicant for employment because of race, religion, color, sex, age, disability, or national origin. 14. Entire Agreement. This agreement constitutes the entire understanding of the parties with regard to the provision of solid waste collection and disposal. No modification of rescission of this agreement shall be effective unless evidenced by a writing signed by both parties to this agreement. 15. E- Verify Compliance. Operator shall fully comply with the U.S. Department of Homeland Security employee legal status E- Verify requirements for itself and all its subcontractors. Violation of the provision, unless timely cured, shall constitute a breach of contract. The parties therefore agree to the following terms and conditions: 1. Terms of Agreement. The initial term of this Franchise Agreement shall be seven (7) years from the date of signing. The Franchise may automatically renew and extend for a subsequent seven (7) year term, contingent upon County Commissioners approval pursuant to G.S. 153A -46. 2. Scope of Services. For the term of this Franchise Agreement, Operator agrees to provide commercial and /or residential customers with solid waste collection and transportation to County- approved disposal sites. 3. Disposal at County - Approved Facilities. Operator agrees to dispose of all waste collected in the County, as part of this franchise agreement, at County- approved facilities consistent with State law. With regard to County- approved facilities, said approval must be obtained by Operator prior to the disposal at said facilities, and said approval shall be granted or denied entirely at the discretion of the County. The County also has the authority to designate which facilities shall be used. 4. Administration /Billing. All billing of customers shall remain the responsibility of the franchisee. 5. Franchise. It is mutually understood and agreed that Operator is an independent contractor and not an agent of the county, and as such, Operator, its agents and employees shall not be entitled to any County employee benefits, and as such, Operator, its agents and employees shall not be entitled to any County employment benefits, such as, but not limited to, vacation, sick leave, insurance, workers' compensation, or pension or retirement benefits. 8. Indemnity. To the extent permitted by law, Operator shall indemnify and hold the County, its agents and employees, harmless against any and all claims, demands, causes of action, or other liability, including attorneys' fees, on account of personal injuries or death or on account of property damages arising out of or relating to the work to be performed by Operator hereunder, resulting from the negligence of or willful act or omission of Operator, its agents, employees and subcontractors. To the extent permitted by law, the County shall indemnify and hold the Operator, its agents and employees, harmless against any and all claims, demands causes of action, or other liability, including attorneys' fees, on account of personal injuries or death or on account of property damages arising out of or related to the solid waste services operated and administered by the County, and resulting from the negligence of or willful act or omission of the County, its agents, employees, and subcontractors. 9. Business Auto Liability. Operator shall maintain applicable Business Liability and, if necessary, Commercial Umbrella Liability insurance with a limit of not less than $1,000,000 each accident. Such insurance shall cover liability arising out of any auto, including owned, hired, and non -owned autos used in the performance of work or services. 10. Assignment, Contracting_ The parties agree that this agreement is not transferable or assignable by either party without the written consent of the other party to this agreement. Operator shall not subcontract with another entity to perform the services described herein without the approval of the County Manager or his designee. 11. Termination. The franchisee may terminate this franchise upon three hundred sixty -five (365) days written notice, or less notice with the consent of the County. The County may only revoke the franchise for cause as set out in Chapter 44, "Solid Waste," of the New Hanover County Code. This franchise may be modified or revoked by the County in the event that an ordinance is passed by the Board of Commissioners creating an exclusive franchise system for residential solid waste collection in the unincorporated County. 12. Non - Waiver of Rights. I am filing a written application to obtain a Franchise Agreement for the New Hanover County Landfill. My company equipment is located at 1727 Oakley Rd, Castle Hayne, NC 28429 and my mailing address is 104 Whitman Ave, Castle Hayne, NC 28429. Coastline Dumpsters is an LLC company. I own eight, fifteen -yard dumpsters and one, eighteen -yard dumpsteralong with one truck. I work full time (shift work) at Duke Energy in Southport. I have minimal experience with solid waste collection, but enough to know what is allowed in the landfill and what is not. I have an agreement that all customers sign before or at the point of delivery and it states what is not allowed in the containers and they get a copy of that information as well. When I pickup the containers I inspect for any hazardous material prior to loading onto the truck. When I dump at the landfill, I perform a final inspection for any hazardous material that may have been hidden under the debris. Any hazardous material found will be collected and placed back into the container for proper disposal. Although separate, both provisions allow for paid leave to employees who are unable to work (or telework) for reasons related to COVI D -19. Last year, on March 18, 2020, the Families First Coronavirus Response Act (FFCRA) was signed into law and it required employers to provide emergency paid sick leave (EPSL) and expanded emergency family medical leave (EFMLA), under each of these acts that were contained therein. Each had their own set of unique guidelines which were applied when it was administered between April 1, 2020 and December 31, 2020. This board approved our implementation strategy during that period. Since there was no extension of benefits under the FFCRA after December 31, 2020, the county modified our sick leave bank enrollment to benefits - eligible employees, who were unable to telework, to prevent them from having to take leave without pay, when they were unable to work for reasons related to COVI D -19. We have relied heavily on our Information Technology staff to provide the tools and equipment necessary that would allow employees to work from home. We will continue to make every effort to continue with trying to accommodate work - from -home situations, as we understand the impact that may be caused by needing to be out of work for reasons related to COVI D -19, even with the leave provided under each act. Under the provisions of the Employee Paid Sick Leave Act (EPSL), employees who do not telework may be eligible for up to 10 days of paid leave for COVI D- related reasons, to include having to quarantine, experiencing active symptoms, awaiting test results, and side effects from the vaccine. Under the Emergency Family and Medical Leave Expansion Act (EFMLA), employees who have not been excluded from this benefit by the county as a healthcare provider or emergency /first responder due to their need for availability to provide crucial functions during this crisis may be eligible for 12 weeks of leave (paid at two thirds of their pay), if they have not already used their FMLA entitlements in the last 12 months. An employee must be unable to work (or telework) due to the need for leave to care for their child under 18 years of age, if the school or place of care has been closed or the child care provider is unavailable due to an emergency with respect to COVI D -19. While extending these benefits under the American Rescue Plan Act is voluntary and it does not amend EPSL and EFMLA or reauthorize the FFCRA, it amends sections under the Internal Revenue Code (I RC). The amended sections allow employers FICA tax credits on wages paid for leave under EPSL and EFMLA. This energy assistance program assists low income persons with heating or cooling related crises. The CIP program is part of the Low Income Home Energy Assistance Program block grant. Households apply for the benefits at their local social services agency. Each county receives an allocation to fund the CIP program based on the poverty level in the county and the county food and nutrition services caseload numbers. Counties have the option to set an annual minimum allowable assistance amount up to a maximum of $600. Payment amounts vary based on the crisis and the amount needed to alleviate the energy crisis. The program funds the CIP benefit payments and are intended to cover all administrative costs. The state did a spending /allocation survey and based on the survey results from the county didn't think the county would use all the money allocated and thought other counties would benefit from the money. There were no unserved households. There is no county match for CIP payments. BA 21 -057 budgets three contributions received from community partners for the Cape Fear Public Utility Authority ( CFPUA) Assistance Program which assists citizens with past due accounts to avoid disruption of services. The program is 100% funded by community partner contributions along with contributions from the city and county. The maximum benefit per eligible household is $500 per fiscal year. These funds may not be used for deposits. Eligibility is based on need and funds available. Funds remaining at the end of the fiscal year are carried over to the next fiscal year. No county match is required. BA 21 -058 decreases the budgeted amount for the Low Income Energy Assistance Program ( LIEAP). The amount budgeted is based on estimates from the state. The state has executed a reallocation for the fiscal year. This program assists low income households with the cost of heating expenses. Eligible households receive a one -time LIEAP heating assistance payment made directly to their heating vendor. The target population is persons age 60 and over, or disabled persons receiving a state service through the Division of Aging and Adult Services. Household income must beat or below 130% of poverty. County departments of social services take applications during the specified time period of December 1 through March 31, or until funds are exhausted. On average VITA volunteers assist approximately 2,300 taxpayers each year with their tax preparation and filing. The total refunds claimed on these returns average $2.4 million per year.
